How much have you had to drink tonight? >> I just had three um the trulies. >> Okay. Okay. Can I check your eyes as part of field sobriety to make you're okay to drive? >> Yeah. >> All right. Tell you what, I'm going to have you step right here in my flashlight for me. Do you wear glasses or contacts? >> Contacts. >> You have them in right now? >> Yes. >> Okay. Feet together. Hands on by your side. >> Can you see my light? >> Yes. >> What color is the light? >> Red. >> All right. >> I'm going to move this red light from side to side. What I want you to do is focus on this red light. Follow with your eyes and your eyes only without moving your head. Okay. Do you understand? Mhm. No, don't guess where it's going. Just focus on it. Keep up. Okay, here we expose your name. >> Paola. >> Paola. Paula, I'm seeing some things in your eyes. It's giving me some concern as far as your level of sobriety. Would you do a couple other field sobriety exercises for me? >> Take what? Uh it's called the walk and turn and the one leg stand >> that I can do because I don't have balance in like my heels. >> I mean I I would if you would prefer to do it without the shoes that's absolutely >> I mean I I can try but >> Okay. >> It's usually with with this I can't do it. >> Yeah. I mean if I wouldn't expect you to try to do it in high heels. >> Yeah. >> Do do you have any other shoes that you might would be able to to change into? >> No. >> No. Okay. Um All right. Paul tell you what. Will you come over here for me real quick? Do you want to just put your purse down for a second? I have it under my jack. >> Yeah. 684. Can I get a 54? Not 108. >> All right. I'm just going to shut your door real quick just to I don't know if anybody's going to come by, but just to just to make sure. >> We're going to step over here into this parking lot real quick. >> My eyes are because my >> Okay. Listen, I got glasses, too. I understand that. But I'm what I'm looking for is very specific things. Okay. Um, tell you what. I'm going to actually Let's step over this way. >> I'm going to have you stand right here for me. I'm going to go grab some tape and come right back to you. Okay. >> Okay. So, what was I doing? Because I drive through here every single day. >> You were all over the road. Like you you crossed over the lane line like four or five times. >> And then as it's 35 through here, you got up to 45. Um and it's just And then you blasted whatever that box was or whatever that was at on Cleveland back there by Dakota. >> Dakota. >> Yeah. I can't remember the street. >> Yeah, it was on Cleveland right there as soon as you cross over the uh the railroad tracks. >> Okay. >> You hit like a big boxer or something like that that was in the road. What happened? >> Oh, I know. I saw that one, but I was I didn't I saw it like afterwards and I was like, might as well just hit it. >> Oh, okay. >> All right. >> I didn't want to swerve and like hit something, so I was like I did see it though. >> Gotcha. Like a cardboard box. >> Yeah. >> Yeah, I saw that. >> That's what it looked like. I know. I saw it. >> Can you do me a favor and just stand on this tape to hold it still for me? >> Yeah, I saw the box and I was like, you know what? I'm like I usually say like if it's not an animal or something or person, I'm like, I'm going to hit the box. Okay. >> Before I get into an accident. >> All right. Just hang tight right there. Did you want to take them shoes off? It's up to you. Do you would you feel more comfortable? >> Yeah. >> Without them? >> It's the same thing probably. >> Okay. All right. Just hang tight. Six in vertical on each by the way. All right, Paula. All right. You see this tape you helped me put down? >> Yeah. >> Okay. What I want you to do is put your left foot on the tape for me. So, go ahead and take take a step off. Take a step off. So, I want your left foot to be the very They're just like that. >> I'm telling you have no balance. >> Again, I mean I I know you got you're not the highest of heels I've ever seen. >> I have no balance regardless of the heels or not. So, that's what I'm saying. We want to do yoga. >> All right. So, I want you to take your right foot, touch heel to toe in front of your left foot. Okay? Make sure you're touching heel to toe. Nope. Hang on. Hang on. Call. I don't want you to do anything until I tell you to. Okay. So, we're going to take a step off. All right. So, left foot on the tape for me. Left foot. There you go. Right foot touch heel to toe in front of your left foot. Hands down by your side. And then just stay like that. Don't move until I tell you to start. Okay. Now, whenever I tell you to start, what I want you to do is take nine heel to toe steps down the line. Okay? I want you to keep your hands down by your side. I want you to look down at your feet and I want you to count each step out loud as you take it. Okay? So, it's going to look like this. So, one, two, three, so forth. So, until nine. Now, once you get to nine, you're going to keep this front foot still. You're going to take that back foot off the line. >> Maybe I should take my shoes off. >> If you if that feel more comfortable, by all means, take your shoes off. >> I have no balance, so I know what shoes. >> By all means, if you feel more comfortable taking them off, that's perfectly fine. All right. >> All right. So, left foot on the line, right foot touch heel to toe in front of your left foot. >> Okay. Hands down by your side. >> All right. So, again, when I tell you to start, you're going to take nine heel totoe steps down the line. Okay? You're going to keep your hands on by your side. You're going to look down at your feet and you're going to count each step out loud as you take it. >> All right? So, it's going to look like this. So, one, two, three, so forth. So, until nine. Now, once you get to nine, you're going to keep this front foot still. You're going to take your back foot off the line and then using a series of small steps, turn around just like this. Okay? Once you get turned around, you're going to take nine more heel to toe steps back down the line just like the first time with the first step being number one. So, one, two, three, so forth, so until you get to nine. Okay? Once you start, I don't want you to stop. >> All right? >> Nope. Hang on. Hang on. Do you understand the instructions? >> Yeah. >> Do you do you have any questions about them? >> Okay. We're going to take your right foot, touch heel, to turn in front of your left foot. So this is the beginning position. Very first time you take a step is going to be number one. If you don't have any questions, you can go ahead and begin. >> 1 2 3 4 5 6 7 8 9 >> just like I showed you and just like I explained it to you. 1 2 3 4 5 6 7 8 9 >> Okay. All right. So, we're not going to worry about the tape anymore, >> but I'm going to have you step right here in my flashlight for me. >> Okay. >> So, step on the flashlight, face towards me. There you go. So, feet together, hands down by your side. All right. And whenever I tell you to start, what I want you to do is raise one foot about 6 in off the ground. Okay? 6 in is about the length of a dollar bill or a can of Coke. Not going to measure, just in that ballpark, okay? About yay high. All right? You're going to keep both legs straight just like you got them. You're going to keep your hands down by your side just like you got them. >> Okay? You're going to raise one foot about 6 in off the ground. Point your toe forward in front of you to keep your foot parallel with the ground below you. I want you to look down at your toe. Count out loud. 1 10002 1003 1004 so for so on until I tell you to stop. Okay. >> Okay. Do you have any questions? >> No. >> Do you understand the instructions? >> No. So 1,00 what? >> You're going to just look while you're looking down at your toe, you're going to count out loud. 1,001 1,002 100,005. And just keep counting until I tell you stop. >> Okay. >> Okay. Do you have Do you understand? >> Yeah. >> Any questions? >> No. >> Okay. You can go and begin. >> One two. >> Make sure you're looking at your toe. >> Oh, one two three four five. I want you to keep going till I tell you stop. >> 1 5 1 6 1 7 1 8 1 9 1 10 11 1 1200 13 14 15 >> I have no balance. >> All right, that's all right. You can relax. So, feet together for me. Hands down by your side. >> All right. All right. What I want you to know is just go put your hands around your back for me. What's going on right now is you are getting placed under arrest for driving under the influence. Okay. >> Really? >> Yeah. Once we get down to booking, I am going to ask that you submit to a breath sample. It's going to measure the amount of alcohol you have in your system. If you don't, there's some penalties that would go along with it. Namely, your license will get suspended for a period of 1 year for a first refusal or 18 months if your license has been previously suspended for a prior refusal. Okay. Will you provide a breast sample for tonight? >> Sure. >> So, I don't want to move this way. Okay. My shoes. >> I'll grab it. >> Uh, we're going to grab them. It's going to be a little hard. >> My phone though cuz >> Yeah, I'm going to grab that. Do Do you have a phone? Is Do you have a phone and a wallet in your purse? >> Yeah. >> All right. I got it for you. >> And then I do need to call my parents. >> Uh, you'll be able to to make your phone calls once you get down to booking. It's not over this way for me. >> 684 10:15. You have a female for search. >> Can I call Can I get my phone, please? >> I'm fixing to go get it right now. >> Grab seat for me. >> Please. >> I'm fixing to go grab it right now. I I need to call my parents right now because they're like gonna yell at me. >> Well, I mean, listen, uh Paula, not I'm not trying to be rude or anything, but you are 34 years old. >> I know, but I'm also Hispanic. And I don't know if you guys are Hispanic, but >> I'm I'm not or >> I am. >> Oh, he's Hispanic. >> But he's also an adult. So, >> you can also call in two to three hours. >> Please. >> So, just slide in for me real quick. I'm going to go grab your phone right now, though. >> But I'm fine. You're not fine. You shouldn't be driving. Slide in. >> I literally had like three >> and that's probably too too many for you. So, slide in for me. >> Um, you want these? >> Uh, she she is a 1016. Huh? >> Yeah, that's fine. That's her mom calling. >> Yep. >> What are you doing right here? There's a key. >> Cool. >> I'm going to leave this this wallet and purse in here, but I got the phone and credit cards. >> No problem. like 60,000 mints in here. Uh I don't know what that is. Pen or something or makeup. >> Makeup probably. Yeah. Leave her jacket. >> Yeah, I'm going grab that. Or no, I'm sorry. I'm going to leave that. That's what I mean to say. No, >> you're good. I got >> All right. I don't really see anything else. Did do you guys have a female this cycle or >> I think it might be the danger, but >> Oh, they're probably Okay. All right. Let me go see. And then she has a 1016. >> Oh, she is a 106. >> Yeah, if you need it for whatever What's that? What's going to happen to my car? >> It's going to get towed. I'll let you know which tow truck company it is that's going to come get it. >> And what's going to happen to me? >> Uh, so you're going to go down to the Orient Road Jail. That's where I'm going to ask that you provide a breath sample. Um, from there, you will have to stay for a minimum of 8 hours. So, it's 12:30 now. So, you're looking at 8:30 would be about the earliest that you could be able to get out. Um, look, it's from the information I have right now, it's just a misdemeanor DUI, which typically is a $500 bond. Um, so I got you had a two or three debit cards or credit cards or whatever in your in your wallet. So I grabbed those. Um, if you have $500 on those, you can use those to bond yourself out. You could also go through a bail bondsman if you wanted to, which typically Okay, which typically that's like 10%. So either whichever way you do it, that's that's kind of up to you. Um, and then from there it all goes through the court system. So tonight you're going to go down to the Orient Road Jail. Like I said, you got to stay for eight hours and then the it's a $500 bond and then after that it's all lawyers talking to lawyers type situation. >> So >> no, it was that you couldn't stay in your lane. You're driving too fast. So it's a whole lot of things. That's why I wanted to make sure everything was okay whenever I first made contact with you. And then whenever I made contact with you, I saw indications of impairment, which is what led me to presume or to begin a DUI investigation. And based on the results of the field soiety exercises and my interaction with you, >> ha, >> she's on the other side. She's she's real cooperative. >> All right, Paul, hop out for me. >> I'm Officer P. I'm just going to search you. Okay. >> Do you have anything at all in your pockets? No, watch. Anything like that? Wallets? Nope. >> Uh, will you take that watch off for me though? Whenever we never get there. I don't get it caught in my rubber p. Yeah, I don't have anything. >> It's like they're like the kind of sort of pockets, you know? I don't Okay, so I'm just going to check the one on this side real fast. They're like so shallow. >> Yeah. >> You know, like they don't really got to like >> Yeah. They don't even come out really. >> No. All right. Go ahead. Look at me. Open your mouth. Put your tongue against the roof of your mouth. Perfect. This guy. I'm going to try not to get all caught up in your house. Do you want any other stuff off or just this? No, >> that's fine. >> Good. All right, you got the hop in. It's like super low. >> I'm going to buckle right quick. Unless you want to sit right there. So, you just come straight across and you bingo bango. >> My seat belt >> mine were for a long time. I had a I had a big old like 6' 7 300lb dude come in straight in and he like ripped the the tensioner off. >> Oh. So mine's like Yeah. Mine almost >> So I when I got my car, one side was working and now I went to buckle somebody the other day and it's like twisted in there. >> Yeah. >> And I'm like I haven't had anybody like I have to pull back there. There's no reason for it to be like that. >> But I think a lot of times if you just get like a bigger person and they kind of like just pull on it the right way, it just gets hung up. >> You have to really kind of >> Yeah, I know. It'll come out like a bug. >> Yeah, that was the problem with mine. >> Thank you. Is there any? >> No. Uh, you you can make a phone call once you get down to booking, but to be honest with you, it's probably going to be a couple hours from that point. >> My phone off. >> Yeah, I turn your phone off so the battery doesn't die. >> 684. >> 684. 10:35 on a CBT 58631. >> Yeah. Well, at least I mean at least you didn't get into a crash and you know you end up in the hospital or something. >> Well, nobody plans on doing that. So it has to be there for 8 hours. >> Correct. >> Yeah, like 8:30 would be there earliest. >> And then my car where? >> Uh looks like B and D Towing, which I believe their location is down by Port Tampa if you're familiar with Tampa. Get out of my house. a couple hours >> for for what to call because it's the the phone call proc or part is kind of towards the end of the intake process. So, you're going to have to, you know, talk to a nurse. They're going to take your fingerprints, picture, uh, get you booked in first, and then towards the end of that is when they let you make phone calls. So, it kind of depends on how busy they are on how long it would take, but realistically, it's probably going to be a couple hours. Now, however much you drank was enough to to impair your normal faculties where you shouldn't be driving. >> Well, that that's might be some of it, too, cuz alcohol with that is going to enhance both of both of their effects. Heat. Heat. Heat. Heat. So after this, when do I have to do >> tonight or in the future? Uh to be honest with you, it's probably going to all go through the court system. So depending on what the breath results are, um the state attorney might will look at it and offer like maybe a diversion program. Um potentially, I don't know, you know, that's that's up to them. Uh and then you're going to have an attorney. Either you're going to hire one or they're going to give you a public defender. and your your attorney and the state attorney will talk to each other and you know if if your attorney feels that taking it to court is the best course of action for you then that's what we'll do. Um if they come to an agreement and you know kind of kind of find something that suits everybody then that that's something that happens a lot too. So I mean there's really a lot of different possible outcomes that can happen. So I can't tell you definitively what will happen. Uh, but it's kind of typically the two most common things. >> Lou, do you know Lou Watson? >> Lou Watson? >> Yeah, >> I don't. Officer Navaro. >> Uh, it sounds familiar, but I can't place him personally. >> Came from Pascal. >> I don't know. >> No, not Pasco. I'm sorry. >> Uh, I might >> the narcotics department. >> Yeah, I might recognize his face, but the name sounds familiar, but I I can't put a name to a face. >> Or Charles Chuck. >> What's the last name? I don't know. >> Davis is kind of a common name, so I don't know about that one. >> Uh, yeah. I'm not sure. Do what? >> Maybe my parents cuz I used to work with them. >> Oh. >> Uh I mean they're if they work they work during the daytime. >> They work night time. >> Oh well. Um cuz I manager. >> Okay. Okay. And they used to work at the right department. >> Okay. Off. >> Gotcha. Charles was there for a long time. >> Yeah. I'm not sure. over here. >> Oh, okay. >> Yeah. >> You still work there or no? and no one on Highway. >> Oh, okay. >> So, you switch from Wells Fargo to Bank of America. >> Yeah. >> As a what? >> Fair enough. Makes sense. >> This was too far. >> Yeah. 684. I'm coming 97 CBT 58643. All right, Paul, I got to read this to you. Can you hear me? Okay. All right. I'm Officer Ben of the Tampa Police Department. I'm now requesting that you submit to a lawful test of your breath for the purpose of determining its alcohol content. If you refuse to take the test I requested of you, your driving privilege will make If you refuse to take the test I requested of you, your driving privilege will be suspended for a period of one year for a first refusal or 18 months if your driving privilege has been previously suspended or if you've been previously fined under Florida statute 327.35215 for refusing to submit to a lawful test of your breath, urine, or blood. Additionally, if you refuse to take the test I requested of you and if your driving privilege has been previously suspended or if you've been previously fined under Florida statute 327.35215 for refusal to submit to a lawful test of your breath, urine or blood, you'll be committing a misdemeanor in addition to any other penalties which can be imposed by law. Refusing to submit the testing is admissible as evidence in a criminal proceeding. Okay. Do you understand that? >> Will you provide a breath sample? All right, let me get you out real quick. But if he's making bourbon check back in Tennessee down in Right. There you go. This tie right here for me. Where's my purse? I left the purse in the car, but I got your cell phone and all the credit cards out of it. All the other stuff was like just makeup and all that type stuff. So, >> sorry. >> They're going to make you sorry. Don't hold the door for me. Anything. >> We're letting somebody else in. Also, >> I call that being rude, but that's just me. >> They tell us the same. >> Yes, sir. >> Come on in for me.
