On September 22nd, 2023, an officer initiated an investigation after witnessing a domestic dispute. >> Hey. Lady. Ma'am, I just saw you. Okay. So, I'm Deputy Rostro with the Sheriff's Office. I'm charging you with domestic violence. >> Yeah. >> What's going on? >> We are in a custody thing right now. I was giving him my the medicine for my daughter so he could leave. >> Did you think that was appropriate to do? >> He wouldn't let me see her. >> Okay. Do you feel like what you did made the situation any better? >> It definitely didn't make it better, but he wouldn't let me say bye to her. >> I understand. So, you can't be doing that, especially with kids right here. All right? >> I didn't throw rocks. >> I understand, but I heard you Well, you can't be throwing stuff, okay? So, technically, that could be charged as assault on a household member or battery on a household member. Is that something that you'd want to do and get in trouble for? >> No. >> Okay. So, what I'm going to ask for you to do is hang tight. I'm going to go ahead and make a phone call, and I have to document it state statute, okay? >> Please do not do this. Please don't. >> Well, I'm Hey, ma'am. I'm I'm already here. >> I know, but please, it was dirt. >> I don't It doesn't matter. You can't do that, okay? >> He wouldn't let me say bye to my daughter. >> You're Well, I'm sorry that you're feeling like that right now. We got to talk about this, all right? >> That's fine. We can talk about it, but don't make it worse. >> It's my policy. So, >> You could have dropped it. >> No, I'm sorry, ma'am. I I can't. What's been going on? How long you guys been >> It's completely unnecessary cuz I'm going to lose my daughter. >> Well, ma'am, I'm not charging you with anything. I'm just documenting it. >> Yeah, but if you document it, he's going to take her right to his attorney. >> Who's his attorney? >> Why do you want to know? >> All right. Well, I'm just trying to diffuse the situation. So tell me exactly what happened. So tell me exactly what happened. They wanted to say goodbye to her and he just wanted me I dropped her off yesterday. And he needed her medicine and how long does he get time with his daughter? >> We do a week and a week. >> Okay and who came up >> it's been iffy. >> Is there a court order in place? >> No and we're trying to keep it out of court >> Okay. >> because I can't afford a lawyer. If I'm not being charged then why is the police here? >> I have to because I witnessed something and I'm I'm here to one document what I witnessed because domestic violence crimes are one of the worst in the nation as well as it needs to be documented. Okay, so if there is other incidents that have occurred I need to make sure that it they don't happen again as well as we offer services. Not only am I a deputy with the sheriff's office but I also help with the speak program which is the the violence against women here in New Mexico. We have victims advocates that come out and try >> understand that this is going to make it so much worse? >> Have you guys been in any type of altercation like this before? >> I think like long time ago. >> Was it physical? >> No. >> Okay. Uh so my daughter's soccer practice I hear shouting and I'm like what's going on? So I look over here and she's yelling um I can't say goodbye to my daughter you're a [ __ ] piece of [ __ ] She used to throw the F bomb a few times. So she's worried that his attorney's going to get wind of it and make her lose the kids. >> She's not that's not there's no crime. This is not a crime. >> Well >> It's not a crime. >> I told her what I technically witnessed. Were you Was you throwing a rock at his vehicle and him leaving with your child. So, I could push that as assault. >> She threw a rock at the vehicle? >> Yeah, as it was driving off. >> Did it damage his vehicle? >> No, no, but it's the act of it. >> I don't know about the assault because it was towards the vehicle, not person, you know. >> So, this is Deputy Corona. He's just going to get the information. Do you have Ronnie's phone number yet? >> So, look, you're not going to get arrested. >> I I know I'm worried about that. >> It's just a documentation. >> to call him. He's going to give this to his lawyer. I'm not worried about it being documented. I'm worried about what he's going to do with this documentation. >> Do you think you did anything wrong today? >> I know that I did, but so did he. >> What did he do? >> He didn't let me see my daughter. He was being ugly about it, and when he drove off, he rolled down the window and said, "Bye." You know ugly that is? >> All right, so that's what he did. What did What did you do? >> I yelled at him and I said something, and I picked up dirt. I picked up right there in the where the gravel is. It was like little things in the very corner. And I threw it, and I even felt stupid when I threw it because there wasn't crap in my hands. >> Where did you throw it at? >> I was standing right there, and it went probably not even past that tree. >> So, you were >> And his truck was over there. >> Were you trying to throw it at the car? You're just saying you pretty much >> I didn't want to hit his truck. >> So, you didn't want to >> I didn't want to hit. >> Okay. >> I got mad. >> I I'm going to be honest with you. I know you're worried about this being documented because he's probably going to give it to his attorney. But I wouldn't worry about that as much as you are worrying about it. This could have been a lot worse today, but thankfully it didn't get bad, okay? It just It was just an argument. It could have gotten escalated. So, just keep your cool. I know it's hard, but if you're going through this stuff right now with attorneys and courts, you got to do everything you can to keep your calm. Okay? Don't let people get under your skin. I get I know. I'm I know it is. I was married to once to somebody and life was hard, but you got to keep cool, okay? It's frustrating. We've all been there. He's been in your shoes. I haven't been fully in your shoes, but somewhat. We understand it. We get it, okay? You're not alone. You're not going through this. >> I've been in your shoes worse. A lot worse. Okay? And I know moments like this you feel like it's going to be tough, but a lot of prayer and God got me through it. Figure things out, what you can do to manage it, make yourself a better person for your children and for you. Okay? Cuz domestics not only affects you and your ex, but it affects the children a lot more. Okay? And you wouldn't want to see your daughter out here doing this type of behavior. >> Hello. I saw Samantha yelling at you and then picking up something and throwing it. What exactly happened? >> So, we we me and her have a daughter together, Samantha. Stuff has been going hectic the last couple Sundays. Um she found out about about a kind of girlfriend I have, threatening to, you know, telling me to kill myself, all this stuff. Anyways, I got all a bunch of crap. Um anyways, yesterday she didn't give me the medicine. She didn't want to give me my daughter at all. And then she ended up giving her to me. And then she didn't give me the medicine. And so, she told me she was going to come drop off the medicine. Well, when this happened, she told me she didn't want to my house and where I have used my daughter. She told me I'm sexually abusing my daughter, all these crazy accusations, all this crap. Um I videotaped the whole thing uh that you seen uh uh from my phone, so you'll be able to everything I I said, which is really next to nothing. >> Yeah. >> started shouting verbal things, all that stuff. >> heard that. That's what made me look. >> And then as soon as I left, that's when she threw the rock. And then did it >> your mother Did it hit your vehicle? >> Uh I think it hit the I don't know where it hit. I don't I'm not going to lie and say it hit my truck or not. I don't know where it went. >> But you did start to see her doing that, were you Did you think she hit was going to hit your vehicle with something? >> Oh, for sure. Absolutely. That's why I kept driving. >> Has she done this in the past? Like >> Oh, she's she's she's also convenient. Yeah, she's she's nuts. Well, and I don't I don't think It's so long. It's been like a year and a half. >> Do you have anything recent that she's done to to cause domestic like to make you fear that there's going to be domestic violence, make you fear that you've been battered or you're going to be battered? >> Uh yep, yep. Um so, last weekend she videotaped this and sent this to my girlfriend uh right in front of my daughter saying over and over, "I'm going to beat your [ __ ] ass. I'm going to >> She did this in front of me, and I'm the domestic violence coordinator for the sheriff's office, so I review all orders of protection, and I review all domestic violence reports. So, um >> I'm about to cry. >> Give me a second, okay, Samantha? >> Can I go and get the spray and my Can you like walk me to the door really quick so I can get it? >> Do you want me to walk you in? >> Well, I can I don't know. He said I couldn't leave. >> All right, yeah. I'll go walk in with you, okay? Hey, partner, you got a minute? >> Yeah. >> Hey, partner. There's a Ring doorbell camera, and I'm going to ask the mom if she had any of any of it. Now, that's recording. All right, would that have recorded that interaction to kind of alleviate any of this? >> Of me talking to the [ __ ] Ethan? Um I can look. >> Yeah, that would be helpful. >> Yeah, he worked last week. He just made >> There it is, Sam. >> Can I take a look at it? >> Thanks. They asked Sam, what am I supposed to do? >> you you don't give it to her, Myra. >> Oh my [ __ ] god. I didn't have this. >> This is wonderful. [clears throat] >> She didn't throw it, she tossed it. >> As I said, I talked. >> Let me take this thing. Jesus Christ. >> You have no [ __ ] idea what I'm going to >> It affects everybody, not just them too. So >> It affects that poor baby. Hi. >> Hi. >> You can come in here. How are you? >> Good, how are you? >> Good. >> Did they call you guys or no? >> No. >> Um does Samantha work here? >> Yes. >> She has a warrant, so I have to arrest her. Yeah. >> Can you see her out the back door? >> Yeah. Okay. I don't know if you knew that you had one. >> What? >> Okay, I'll take you to my car. >> Okay. >> So, you you have a warrant, okay? For what? For battery on a household member. I don't know who somebody called and said that you were here. That's how I knew you were here. Um >> [snorts] >> No one told me I had a warrant. >> Yeah. >> Something happened, but battery wasn't a thing that happened. >> Yeah. Um so I have to take you to jail, okay? >> This barely happened. >> deputies go over there? >> Yeah, but they said that they were so The charges is no nothing. They just had to document it. >> Yeah. So they may have went through their investigation and decided that charges needed to be filed, because it doesn't matter if even if he did said he didn't want to press charges or something, if we feel like charges needed to be pressed, we have to go through with it, okay? So, um what's the last four of your social security number? >> Can I at least call my mom? >> Yeah, yeah, I'll let you I'll let you call, but I just need the last four of your >> I've never been arrested. >> okay. I understand. That's why I didn't want to take you through the front or nothing like that. >> what's a warrant? Like >> I can explain it to you, but I need the It's last four of your social. >> I'm not going to I'm going to be in jail all weekend. >> Till Monday? >> No, >> Yeah. but no, I can't. Mhm. Please say not. >> There's >> I have too much anxiety. I cannot be in there. >> I understand, but there's nothing that I can do that can get you out of jail cuz there's no bond. So >> Mom. Dude, the cops came to my work and they're arresting me. >> For what? >> For battery on a household member. >> Who has your kids right now? >> I don't want to speak. >> And is he supposed to keep them throughout the weekend? >> No, it was my weekend. I was supposed to take my kids to dinner. >> Well, your mom is right, too. The longer we take here, the longer she and she may not get a chance. >> and you know it. >> I'm not. I told you I wasn't going to lie to you. So, I've already said that. >> What? Am I going to be around all those other people in there? >> shouldn't be. Usually they put you in a cell by yourself before. >> And I just sit there for the whole weekend? >> They may. So, what happens is they may put you with other people, but there's a TV and stuff in there. Like I know it sucks and I've I've never been to jail, so I can't say that I know what it's like, but like I said, I used to work in there and I feel like maybe you're high in your head and you're making it bigger than you think it is. >> I'm not. >> Cuz it's really not that bad. I >> It really is. >> It Have you been to jail before? >> No, but I've been to a psychiatric unit. >> Okay, it's but it's not like that there. >> And there's all these ghetto people in jail. Can I Can I smoke a cigarette, please? >> Where are they at? >> They're in my car. You can like walk me to my car or I can I don't even know where they're at. >> Let's do this. Let me Let me put you in cuffs. Let me take you outside and I'll go get We'll go get your cigarettes from your car and I'll let you smoke before. >> So, you can't uncuff one hand? Then how am I supposed to smoke? >> I I can't. It's better than than nothing. Just try your best. >> The woman was charged and convicted of battery against a household member.
