Yeah. >> Well, I told her she was going to get tased and then she swung in my face so she got tased. [Applause] >> Left or right? Hey everyone, it's Trent, prior deputy sheriff, patrol sergeant, and canine handler. The domestic violence laws do not only apply to people that are in dating relationships or that are married to one another. Situation like this can still apply in certain circumstances to people that are cohabitating with one another and they are related. So, this mother and her adult daughter and domestic violence laws are treated a little bit different than other laws because of the major liability involved. So, a lot of states make it a mandatory arrest no matter what for domestic violence allegations, especially if there's visible injury. Sometimes you do not even need a cooperative victim. In this case, we see that the mom wants to press charges on her daughter and she wants to be a victim of domestic battery. So, according to the mom, her daughter suffers from mental health issues. She's off her meds and she attacked her earlier on in the evening. The mother stated her daughter choked her and punched her in the face. It is notated in the officer's report that he observed visible injury to the mother's eye. It's red and swollen, indicating a physical altercation took place. Now, because of these types of laws and because the daughter, the suspect, refused to cooperate, provide a statement, and decided to lock herself in the bathroom, it was an easy decision on behalf of law enforcement just to go ahead and place her under arrest. So, when she finally came out, that's why he automatically told her she's under arrest. And then when she pushed into him trying to get past him, that was obviously another charge for battery on a law enforcement officer. That same officer did tase her once they got into the bathroom. According to him and his report, she tried to hit him on two separate occasions and he decided to tase her. So, you're going to be looking at the laws on that to overcome the resistance and to affect the arrest. When you have somebody like this suspect who's very aggressive, clearly wants to fight, is screaming, sometimes you're going to look at using a level of force like the taser to try to gain that compliance and maybe prevent any further or imminent injury to yourself or to the suspect in this situation. But for somebody like this suspect who probably does suffer from mental health issues and more than likely is not taking her medication even if she was not arrested for domestic battery because it didn't qualify or meet the criteria, these officers still potentially could have placed her on a 5150 hold, which is a mental health hold because she is clearly a danger to herself and others. And that's going to be it for this one. See you guys in the next one. >> The suspect had physically assaulted her mother. She also struck an officer while being detained and was charged with aggravated assault, aggravated battery, resisting peace officer, and domestic battery. She remains innocent until proven guilty.
