I don't want to be here when she comes. I can't do this. >> Life would never be the same again. How could I do this twice? >> A grief-stricken grandmother faces her family after admitting to a fatal mistake, but as the details unfold, those closest to her are forced to relive a nightmare they never imagined they'd see again. Around 5:00 p.m. on November 1st, 2022, a dispatcher answers a heartbreaking call about an infant in desperate need of help. >> 911, where is your emergency? >> I don't know. I just pulled up, but we need EMS, like immediately. >> All right. Is left in the car? Is she breathing? >> I don't What happened? I have no idea. >> Oh, no. Oh, no. >> Oh, my goodness. >> Okay, how does she look? >> Her eyes are open. She's not moving or breathing. >> The caller, Rebecca, tells the dispatcher that her 65-year-old mother, Tracy Nix, had left her other daughter's child inside a scorching hot vehicle for hours. >> Okay, I know that you're wanting to leave. Is there any way I can talk to somebody that's there? Is Tracy there? >> See, I don't know where she's gone to. She's going to call you. >> Okay, she's going to call me? >> Yes. >> I I understand. I'm familiar. I was here with the first time. >> Yep. I this is about to be really, really, really bad. >> Deputies with the Hardee County Sheriff's Office arrive at Tracy's home, where she's found sitting behind the house. She's questioned about what happened, and her answers reveal a painful chain of events. >> Tracy, do you have any idea, maybe, how long it's been? >> It could have been up to 2 hours. I forgot I had her. >> Okay. >> I took her out to lunch with some friends. And when I got back, I don't know we even what I had on my mind, but I didn't get her out of the car, and I didn't think about it again until I was getting ready to get my other grandson and take him >> [laughter] >> out to dinner. And all of a sudden, it dawned on me that she was with me. >> I understand. >> Tracy says that after having lunch, she returned home and parked her car before going inside the house. However, she ended up leaving someone behind, 8-month-old Yuriel Shock. >> I'm going to get in my car and I need to just go somewhere. Well, I know you're going to arrest >> I need to get a statement from you though, okay? Are you Are you okay to do a statement? >> Yes. Yes. >> Do you want to go back to the sheriff's office and sit with me? Would that be better? >> I don't want to face anybody. >> Okay. >> I can't [clears throat] face my daughter. >> Tracy explains that she was waiting to meet one of her two daughters, Rebecca and her grandson. When she knew they were close to the house, she drove to meet them on her property and stopped to speak to her husband as he was mowing the lawn. Moments later, Rebecca pulled up as they made the shocking discovery. >> In which vehicle was Tracy in? >> In the red Lexus. Well, I pulled up to her as I sat on the lawn mower. I stopped, talked to her for a minute. She seemed very normal. And then all of a sudden, I saw her expression change. She said, "Yuri! Yuri! Oh, no!" She pulled the back door open and she started screaming. >> Tracy and her husband found Yuriel lifeless in the backseat of Tracy's car with the windows rolled up and in 90° temperatures. She was still wearing her red footie pajamas covered in little flowers. As police continued to gather statements, Tracy admits this isn't the first time her family has seen a horrific tragedy like this before. >> I know my limits. I can't do this. >> What does that mean you cannot do this? >> I can't do it again. I can't watch everybody be in such pain because it's an action of my own. She was the most precious child as was her brother. I can't imagine anyone Anyone else has been well since she was her last baby. I cannot imagine her going to be an infant. You got to see this Kayla please. >> How did you and Kayla get through it last time? >> [snorts] >> She extended grace to me that's about the only way to put it. She did it the way that it happened it was just an accident. >> Okay, so what's different about this time? >> [laughter] >> He's rather chill. I don't care. >> Was this time an accident too? >> It was. >> Okay. >> Police records reveal that 1 year ago Tracy had been caring for her 16-month-old grandson Ezra when she admittedly fell asleep inside her house. When she woke up Ezra was nowhere to be found. >> And then I came out here and walked all around and couldn't find him and I got in the car and went to the stop sign and started going to the other end and I turned back around and I saw him in the pond and I came across the pasture and he was face down. >> That day on December 22nd, 2021 Ezra's father arrived on Tracy's property only to be confronted with a heartbreaking scene no parent could ever be prepared for. >> They're working on him. If you go in there you will interrupt them and stop them. Go talk to him. Go talk to him over there all right? Can you see him? Make sure you don't pull out no gun or nothing. >> Okay, there you go. >> I understand. That's not your god damn kid. Don't tell me what the I am BUT YOU SEE ME >> COME ON COME ON COME ON COME ON MAN. Come on man. >> When asked how Ezra was able to get outside Tracy said a door near the garage was found open and her husband likely didn't close it when he went to the store. As Ezra's fate hung in the balance Tracy was about to face her daughter who at the time was pregnant with Uriel. What happened next was a gut-wrenching moment that could forever change a family. >> They're going to land the helicopter so try to wave her over here to the driveway. Watch out. Watch out. >> [screaming] >> STOP. STOP. STOP. STOP. >> [screaming] >> YOU NEED TO GET HER BEHIND THIS FIRE RESCUE. >> [screaming] >> GET UP. GET UP. GET UP. GET UP. >> [screaming] >> WHERE IS THAT GIRL? >> SHE'S IN THE HOSPITAL IN THE AMBULANCE. >> IS SHE ALIVE? >> I DON'T KNOW. >> YOU LIED. >> I DON'T NO. I'M HERE, BABY. COME ON. COME ON. COME ON. COME ON. YOU'RE BREAKING OUR SON OUT. >> I WANT MY I NEED >> Despite efforts to save Ezra, he was pronounced dead after drowning in the pond on Tracy's property. Now, 1 year later, Tracy says her husband attempted CPR on their other grandchild, Uriel, after she was forgotten in the car. First responders arrived and took over, but she could not be revived. Uriel was pronounced dead at 5:01 p.m., making this the second time that Tracy's daughter, Kayla, lost a child who was in her mother's care. >> Do you keep her child often? >> Last week I had her for tonight and 5:00, but typically I just have her once or twice a week. >> Was there anything different about today? >> No. Except that I didn't expect to have her. But who could do that? Who could do that? Who could have >> [gasps] >> Who does that? >> What do you mean? >> Who could forget that a baby's in a car? Who could do that? >> I'll be with you in a sec, okay? Miss Tracy? >> Yeah. >> I got someone who's going to sit with you for a little bit, okay? Hi, baby. I'll come back and check on you later, OKAY? COME HERE. >> I NEED TO BE TALKED AWAY SOMEWHERE. I need people home. I was with my best friend and it will never be the same again. How could I do this twice? >> Nothing was malicious. Nothing was premeditated. Nothing. >> As her friend consoles her, Tracy is asked to retrace her steps from earlier that day before the unthinkable happened. >> Whose idea was it for you to get Uriel for lunch? >> [snorts] >> Kayla asked me if I would because she was getting her hair done. >> Okay, so you went from prayer to get her to go to lunch. >> Tracy says she was with her prayer group from 10:00 a.m. to 11:30 a.m. She then drove with a friend to pick up Uriel at the request of her daughter Kayla, who needed a babysitter. Surveillance footage confirms Tracy and Uriel entered a restaurant around 12:28 p.m. More than an hour later, cameras show Tracy, Uriel, and Tracy's friends leaving the restaurant. It's the last time Uriel is seen alive. >> How was Uriel during lunch? >> She was great. I was getting things. >> I know. You're doing a really good job, though. I appreciate it. >> She's doing good. She had put my baby's crib to my head where we could be a family. Pray it could work out. I just thought I was enough of a person to face it. >> As Tracy gives her statement, deputies back at the scene reach out to Kayla and Uriel's father to notify them about the unimaginable loss of their youngest child. >> God damn it. Nobody Nobody's going to sign anything. There's no point going there. Jesus. Right, where's my wife? >> I think she's at home now. We can't get a hold of her. >> Where's our daughter? >> They airlifted her? Is that what's going on? >> This hospital here? >> Kayla Nix is the mother? >> Yes, she's 7. >> Where is she at? >> Probably at home. Do not go there to get her. Do not let her drive. She caused the next incident the last time. She was going to be extremely extremely and strong. We buried the last one. >> Later that night, deputies speak with Kayla after she learned the tragic news about her daughter and that her own mother is involved in yet another one of her children's deaths. But as painful memories resurface, Kayla will ultimately face a decision about Tracy's fate. >> So, I said you could just take Yuri with you to get lunch. It's been incredibly complicated since Ezra and I've made every effort that I have in my soul not to alienate >> [laughter] >> alienate Ezra and Yuri from them. And we've been very spry with it only in the daytime, only with both of them there because I This is These are just some of my friends. >> Yes, they are. >> And I just >> Did >> I was trying. We talked about this since Ezra died. >> I can imagine that. >> And if she could move away from her on her own, then that was the cut off in terms of in terms of what we could emotionally endure in terms of trying to allow that relationship. >> Stupid. How has that been since then? >> Oh, it's been very It's been contentious. >> The only reason we let our kids over there was for Nate. >> My father to my understanding was not directly involved in my son's drowning. And and he was my parent. He's my person. My mom, I've never had a good relationship with her. We've never had a good relationship. I've had the closest thing to a decent relationship I've had with her is as a mom to a like a grandmother to my grandchildren or to my children. And that ended, you know, December of this past year. She's never told me never told me what happened to my son. And that's because at the time I was pregnant and they was literally like you choose. Do you mourn Ezra or do you choose Yuri? Do you find out what happened to Ezra or do you have Yuri? That is literally what they told me. >> Tracy avoided charges following Ezra's death, but with Uriel, she finds herself facing very different consequences. >> They said that they they're going to press charges this time. >> It'll be investigated and if the medical examiner determines it's a homicide, then that's how it will proceed. The only concern that we have is later retaliation and unfortunately we'll have to deal with that. Expecting it to come, but we hope it doesn't because that's only going to complicate things. It's not going to further Yuri's case at all. We don't want to leave anything out that is necessary to help give Yuri some rest. >> Yeah. >> And unfortunately that involves prosecuting your mom. >> The medical examiner estimated that Uriel died not long after being left in Tracy's vehicle due to the undigested food found in her stomach during the autopsy. Uriel's death is ruled a homicide. >> The last little king that we had just about killed me. I'm pretty sure the relationship between mother and daughter is broken. >> Mother and daughter meaning Tracy and Kayla? >> yes. I don't think they blame me for anything other than how could this happen again? >> Sure. >> According to court documents on November 14th, 2022, Tracy Nix was arrested and charged with aggravated manslaughter of a child and leaving a child unattended or unsupervised in a motor vehicle. She was ordered to have no contact with her immediate family including her grandchildren. At Tracy's sentencing hearing, Yuriel's father Drew stated, "She's done this twice and the fact that we're debating whether or not she deserves jail time is just insane to me." Kayla asked the court to honor her children's deaths as it considered her mother's sentencing. She looked over at Tracy as she concluded her statement and said, "I love you and that has not changed." Tracy was found not guilty of the manslaughter charge and adjudicated guilty of leaving a child in a motor vehicle in excess of 15 minutes causing great bodily harm. She was sentenced to 5 years in prison. Tracy's case is currently with the state of Florida's court of appeal.
