The footage presented in this video is for educational and informational purposes only. It is not intended to ridicule, shame, or defame any individuals involved. All content complies with applicable laws and is shared in accordance with fair use principles, where applicable. Viewer discretion is advised. The Details are from corroborated testimony from other officers on the scene during this incident. The Body-worn video was taken from Officer 3. On the 23rd of 2019, patrolling officers in a western Sydney suburb at approximately 9. pm, Officer 3 and Officer 4 spotted a pedestrian on the sidewalk, not steady on her feet. Cilvian 1 was stopped by both officers; she had a handbag and a suitcase. She was questioned by officers because of her alleged state, and the area was known for its common drug-related activities. During questioning, she provided her name and stated the reason why she was out that night. She was visiting a friend and looking to "score" later, is what she said. As the conversation progressed, Cilvian 1 became agitated and attempted a check drill (push/shove) on Officer 3, which caused her to fall down. Both officers attempted to assist Cilvian 1, but Officer 4 was almost attacked near the face and was sworn at by Cilvian 1. As officers helped Cilvian 1 up, she began to fall onto the concrete and started lying at officers whilst banging her head on the ground. She was placed into handcuffs by officers to prevent her from hurting herself. The officers called the Ambulance service out of concerns about Cilvian 1's health. A request for a female officer was also made shortly after the call for medical. Officers 5 and 6 arrived as a result of the call, Officer 5 being the female officer. Officers 1 and 2 arrived not far behind the other responding unit. Officers searched through Cilvian 1's belongings on the street. She was suspected of stealing a handbag due to the tags still being in place. She was cautioned and placed under arrest. Officer 5 began the search on Cilvian 1's person with the officer running her hands across her body. Cilvian 1 voluntarily lifted her dress up with one of the officers asking her to put it back down. Cilvian 1 turned toward Officer 5 and lifted her leg at the officer. Officer 1 stepped in front of Cilvian 1, raised his arm up, and grabbed Cilvian 1's neck. The video is switched off by Officer 3 shortly after this exchange. The Law Enforcement Conduct Commission (LECC) was provided with this incident and started investigations into the officers involved in this incident. Through private interviews and all the officer's testimonials from that night, the LECC made a recommendation to Officer 1. It was recommended to the New South Wales Police Force that the Officer be handed down a non-reviewable action under section 173 of the Police Act (1990) "Commissioner may take action with respect to police officer’s misconduct or unsatisfactory performance".
