Officers observed the vehicle driving recklessly and failing to maintain its lane. Upon contact, they detected a strong odor of alcohol, noted glassy eyes, and observed the driver stumbling over words. The officer obtained the driver’s license and began a summons for failure to maintain lane (39:4-88). The driver admitted to consuming one alcoholic drink and meeting a friend in Montclair. The officer instructed the driver to remain in the vehicle while waiting for backup. When another officer arrived, the driver initially refused to exit but eventually complied, using the vehicle for balance. Alcohol odor was further noted, and the driver refused field sobriety tests, citing concern for a family member and requesting to be escorted home. A verbal counting test was attempted but performed poorly, and the driver declined additional tests. The driver repeatedly refused the HGN test and was arrested for DUI based on observations, handcuffed, searched, and placed in the patrol vehicle. Miranda Rights and the Standard Statement for breath tests were read, but the driver gave inconsistent answers and ultimately refused to provide a breath sample. The driver was transported to headquarters for processing.
