Virginia State Trooper Incident on I-495 Fairfax County Virginia USA Bodycam News Police Encounter On April 20 2019 around 4:15 p.m. Derrick Thompson of Woodbridge Virginia was traveling north on Interstate 495 the Capital Beltway near the 51 mile marker in Fairfax County Virginia USA when a Virginia State Police trooper initiated a traffic stop for an expired inspection decal. During the stop the initial trooper confirmed Thompson was driving on a suspended license and reported detecting an odor of marijuana from the vehicle. Additional troopers responded including Trooper Charles Hewitt. Thompson began recording on his cellphone as the situation developed. He kept his hands visible stated repeatedly that he was not a threat and expressed that he felt unsafe. Hewitt reached through the window unlocked the door opened it and leaned in. On the recording Hewitt can be heard saying take a look at me I am a specimen right here buddy you are going to get your ass whooped in front of Lord and all creation and watch the show folks. Thompson continued stating his hands were up that he was not resisting and asked the officers not to touch him. Hewitt then informed Thompson he was under arrest and forcibly removed him from the vehicle. Thompson later received a medical evaluation for a minor abrasion. Thompson was charged with obstruction of justice driving on a suspended license and the expired inspection. He pleaded guilty to the misdemeanor obstruction charge in 2019. The remaining charges were dismissed. Video of the encounter became public in July 2020 prompting Virginia State Police to open a criminal investigation and place Hewitt on administrative leave. Superintendent Col. Gary Settle stated the conduct was not in agreement with the standards required of a Virginia trooper. In October 2020 Fairfax County prosecutors declined to file charges against Hewitt describing the demeanor as reprehensible but concluding the force used was legal under the circumstances. Thompson filed a federal lawsuit alleging assault and violation of constitutional rights. In April 2021 the case settled for 20000 dollars with no admission of wrongdoing by the Commonwealth. During settlement discussions Thompson's attorney was informed that Hewitt had been terminated for cause with a last day of February 25 2021. Virginia State Police confirmed he was no longer employed but cited personnel rules limiting further details. As of August 2026 no additional public records show further lawsuits settlements reinstatement or related court actions involving either party from this specific Fairfax County incident.
