On May 28th, 2023 at approximately 5:00 PM, Officer Gorham of the Ventnor City Police Department was on routine patrol when he observed a White Volkswagen sedan run a red light and improperly pass other vehicles, including his own marked patrol vehicle, on the roadway. Officer Gorham then caught up to the vehicle on the 100 block of Portland Avenue where he located the vehicle backed into a driveway of a residence. Upon exiting his patrol vehicle, he observed the driver, later identified as Zachary W. Fischer (of Ventnor City) out of his vehicle speaking with two unidentified persons who reside at the property. The male owner exclaimed that Zachary had backed into his Porsche which was parked in the driveway. Officer Gorham then notified central communications he was out with a minor motor vehicle accident. As he collected both involved parties vehicle and identification information for the accident report, Zachary was unable to produce proper documentation. Zachary exhibited several signs of impairment and a second officer was requested for field sobriety testing. Officer Sochocky arrived on location shortly after at which time Zachary was removed to a separate area for testing. Officer Sochocky then completed the HGN field sobriety test in which Zachary exhibited signs of impairment. She then conducted the walk and turn test which was later halted due to Zachary’s inability to maintain his balance (testing stopped for safety reasons). He was then placed under arrest for driving while intoxicated (39:4-50). A search of his person incident to arrest yielded positive results for controlled dangerous substances (CDS/pills/suspected alprazolam(2mg)). He was transported to Ventnor City PD where he produced samples of his breath for testing and a BAC reading of 0.03% was collected. Due to the suspected level of impairment not matching the test results, Zachary was asked and ultimately provided consent for a urine sample. A Drug Recognition Expert (DRE) was requested and provided by Galloway Police Department. The female passenger (and registered owner) of the vehicle was issued citations for allowing unlicensed driver to operate vehicle and allowing impaired driver to operate vehicle. She was arrested and transported to county jail on an outstanding warrant. Seized CDS and urine sample sent to the lab for analysis. Zachary was charged with the below traffic and criminal offenses: Driving while intoxicated Open container Unlicensed driver Driving while suspended Improper passing Failure to observe traffic control device Improper backing Possession of CDS (Criminal/3rd Degree) Driving during a period of suspension due to DUI (Criminal/4th Degree) Due to driving while suspended (with suspension resulting from a DUI conviction), Zachary now faces jail time. This is Zachary’s fourth time being charged with driving while suspended as a result of a DUI conviction. ________________________________________________ Please LIKE, SUBSCRIBE, and COMMENT below with your thoughts on this week's video.
