The caller, an employee of the business, stated that they witnessed three people that they had seen drinking alcohol in the establishment arguing in the parking lot over who was going to drive. The caller stated that he saw them stumbling and that they were visibly intoxicated. The caller then stated that the vehicle drove off and described it as a Volvo SUV and gave the license plate. An officer in the area located a vehicle that matched the description and was bearing the license plate, a close match to the one described by the 911 caller. The officer followed the vehicle to observe its driving behavior and observed the vehicle fail to maintain its lane more than eight times. The officer then conducted a traffic stop on the vehicle and identified its driver as Melissa Murdock-Anderson. The officer who conducted the traffic stop notified me and asked me to respond to the location in order to conduct an impaired driving investigation. The officer informed me that Anderson was very clearly intoxicated. I arrived on scene and met with Anderson. I first asked Anderson how many Adult beverages she had consumed and she stated that she had not drank any. I confirmed the initial officer's observations and was able to observe that Anderson was indeed very clearly intoxicated; I observed the following physiological indicators that are consistent with impairment by Central Nervous System (CNS) Depressants such as Adult beverage: ● Glassy and bloodshot eyes ● Swaying of the body while standing ● Strong odor of an adult beverage emitting from her person ● Depressed reflexes ● Extremely slurred speech ● Sluggish movements Due to the indicators officer observed, Officer asked Anderson to participated in Field Sobriety exercises. Anderson responded to the question by stating "sure, but I wont't blow!" This was presumably in reference to a breathalyzer examination. All front-facing emergency lighting was de-activated before performing field sobriety exercises and the exercises were performed on level-ground. Anderson stated that she normally wears eye-glasses but she was not wearing them at the time. Horizontal Gaze Nystagmus: ● Equal tracking and pupil size observed in both eyes. ● Lack of smooth pursuit observed in both eyes. ● Distinct and sustained nystagmus at maximum deviation observed in both eyes. ● Onset of nystagmus prior to 45 degrees observed in both eyes. ● I had to perform several passes of each state as Anderson showed difficulty in tracking the stylus. Vertical Gaze Nystagmus: ● Observed in both eyes. Walk and run: ● Failed to maintain instructional stance ● Began before being told. ● Several steps off line. ● Several steps not heel-to-toe. ● Improper turn (did not take a small series of steps around lead foot.) ● Stopped briefly while walking. One Leg Stand: ● Swayed back-forth and left-right. ● Put foot down. Lack of Convergence: ● Observed Modified Romberg Balance: ● Correctly estimated thirty seconds. Due to the indicators officer observed during the investigation, officer placed Anderson under arrest (handcuffed behind the back, double locked.) Officer read Anderson the State of Georgia Implied Consent Notice request breath, which she refused. Officer re-read Implied requesting a blood sample and Anderson again refused.
