Full report is below: "On March 19th, 2023 at approximately 2021 hours, I officer Austin Hoppe with Florida Fish and Wildlife Conservation Commission, was on routine water patrol with United States Coast Guard. I observed a vessel pulling into the boat ramp at Demons Landing (Pinellas County). Boarding officer Tomlinson and I approached the vessel and advised we were going to perform a quick vessel safety inspection. While officer Tomlinson was performing the inspection, I noticed one of the passengers on the front of the vessel was trying to talk to me. As I was talking with the individual, I noticed that he had a slurred speech and had a strong odor of alcohol coming from his persons. Officer Tomlinson advised that he was all done with the inspection and that they had all the safety equipment they needed. Myself, officer Rodriguez and USCG were sitting at my agency issued vehicle typing up paperwork when I hear a vehicle rev its engine multiple times followed by yelling. When I looked over at the boat ramp I saw a individual in the driver seat of the vehicle with the vehicle turned on and in drive attempt to pull the boat out of the water. The individual continued to hit the gas even after he was told that the parking break was on. Another guy pulled the individual out of the driver seat and pulled the vessel out of the water. I then walked back over to the individual and asked to speak with him. He became very agitated and kept telling me he did not want to talk to me. I then advised him that I witnessed him get into the driver seat of the vehicle and attempt to drive the truck. He then told me that I did not see him in the driver seat because he never got into the driver seat. I was able to identify the operator of the vehicle via his Florida Driver license as follows: (redacted) As I was speaking with Mr. (redacted), I again noticed a strong odor of a alcoholic beverage coming from his persons and slurred speech. When I asked Mr. (redacted) where his ID was, he was having a hard time remembering. I asked Mr. (redacted) if he would perform a few tasks so I could make sure he was able to operate a vehicle safely. Mr. (redacted) continued to say that he was not going to be driving a vehicle. After I advised him that I watched him take control of a vehicle he told me that it did not count as driving cause he never moved it. I then asked him again if he would perform the tasks and he stated “No”. I then advised him that based on my observations and the signs of impairment he has shown that I was placing him under arrest for Driving under the influence. I then read Mr. (redacted) implied consent and he refused to give a breath sample. Mr. (redacted) was arrested for the following: -316.193(2)(b)3- DRIVING UNDER THE INFLUENCE - ALCOHOLIC BEVERAGES, ANY CHEMICAL SUBSTANCE, OR ANY SUBSTANCE CONTROLLED AND THE PERSON’S NORMAL FACULTIES ARE IMPAIRED. Since Mr. (redacted) refused to provide a breath sample, his drivers license was surrendered. Mr. (redacted) was transported to Pinellas County Jail by Pinellas County transport van. Body camera footage available upon request. Nothing further. End of report."
