NORMAL, IL - At 2:47AM on January 19th, 2020 a Normal Police Officer pulled over a driver who did not stop at a stop sign. The suspect claimed that he was looking at his GPS while trying to pick up a friend. The officer asked for insurance, but the suspect gave him the registration instead. Upon confirming the documentation given by the suspect, the officer asked him if he had been drinking earlier in the evening. Initially, the suspect told the officer he had nothing to drink, but later admitted to drinking. When asked if he was sure he did not have any alcoholic beverages, the suspect responded, "I had like two way earlier though." Once the suspect admitted to drinking, the officer asked the suspect if he would be willing to perform a field sobriety test (FST) at the station. The suspect said, "I'm really not interested in that." The lead officer then discussed the situation with another officer. The secondary officer told the lead officer that the driver had no choice and would have be to arrested and brought down to the station for processing a formal refusal. The officer then approached the suspect's vehicle and told him that he would be placed under arrest and transported down to the station. Once there, the suspect told the officer that he would prefer not to perform the FST. The officer proceeded with completing the paperwork for the refusal and informed the suspect that his next option was to take a breathalyzer test. As an implied consent state and by refusing to take a breathalyzer test, the suspect was told he would lose his driving privileges in the State of Illinois for a minimum of 12 months. The suspect was once again given the opportunity to blow into a breathalyzer to which he refused. The suspect was explained again the potential consequences if he refused the test. The officer informed the suspect that his license was suspended for 12 months following the refusal. The suspect was read his Miranda rights and began answering questions regarding the traffic stop as part of the driving under the influence (DUI) investigation. The suspect then proceeded to tell the officer that he had been operating a vehicle, but was not under the influence of alcohol. The secondary officer later found alcoholic beverage containers in the suspect's vehicle. When asked why he refused the tests, the suspect answer, "I just don't think it's necessary." At the hospital, the suspect was informed of a judge's search warrant signed in the early morning hours. The suspect was informed that he was compelled to either move forward with the blood sample or be charged with felony obstruction for disobeying the search warrant. Upon completion, the officer received possession of the blood sample taken at 4:45AM and the suspect was taken to the county jail for further processing. He was then charged with (DUI).
