Sorry about the poor audio. They are innocent until proven guilty. Official report below. "On September 29, 2024, I, Officer Benjamin Johnson II of the Florida Fish & Wildlife Conservation Commission, along with Lt. J Louque were on routine land patrol on national forest road (NFR) 301 in the Apalachicola National Forest. Upon reaching the intersection of NFR 301 and forest trail 0604A, we noticed a silver Chevy pickup truck with all four doors open on forest trail 0604A (trail is designated for non-highway legal vehicles wider than 50 inches, ATV’s and motorcycles). As we turned onto the trail, we noticed a male subject, standing on the truck bed of the vehicle who appeared to be loading something in the bed of the truck. As we approached the vehicle, the male subject jumped down from the tailgate of the truck and got in the driver’s seat and closed the door. Lt. J. Louque and I parked in front of the subject’s truck and exited our marked patrol vehicle and instructed the male subject to stop the truck. Upon approaching the subject’s vehicle, I noticed that there was also a female subject in the passenger seat of the vehicle. While Lt. J Louque asked the subjects what they were doing on the trail, I walked to the bed of the truck and observed several large burlap sacks full of what appeared to be Saw Palmetto Berries. Lt. J. Louque and I instructed the 2 subjects, later identified by their Georgia Driver Licenses as Mr. Isaias (redacted) and Mrs. Natividad (redacted), to exit the vehicle. When asked what was in the bags, Mr. Isaias stated that there were berries in the bags. When asked if there were any other people in the forest who had picked the berries, Mr. Isaias stated that it was only him and his wife that picked all the palmetto berries. After obtaining the subjects driver licenses, Lt J. Louque advised the subjects that harvesting the palmetto berries is a felony and asked if the subjects had anyone who could come and pick up the truck to avoid having the truck towed, which they advised they did not. Being that the roads leading to forest trail 0604A had several flooded mud holes that would be highly difficult to get a tow truck through, we advised the subjects to follow us in their vehicle to NFR 325 just south of Highway 20. The subjects were compliant and followed us to a safer location to tow the vehicle. Upon reaching NFR 325 and Highway 20, Officer H. Keels, 2 Leon County Sherrif Deputies and HobKirk towing & recovery arrived at our location to assist with arrests and towing. A vehicle tow receipt and vehicle inventory list were completed, and 6 bags of Saw Palmetto Berries was seized and destroyed by Officer H. Keels. The two subjects were transported and booked into Leon County Jail under the following charges: 1. 581.189(6)(c)- THIRD DEGREE FELONY, CONSERVATION-ENVIRONMENT- UNLAWFUL FOR ANY PERSON TO DESTROY, HARVEST, OR SELL SAW PALMETTO BERRIES ON THE PRIVATE LAND OF ANOTHER OR PUBLIC LAND WITHOUT FIRST OBTAINING WRITTEN PERMISSION AND REQ PERMIT The above incidents were documented on my agency issued body worn camera. Photographs were taken on my state issued cell phone. The above incident occurred in Leon County. I have nothing further to report at this time."
