Summary of the Police Report: On June 28, 2023, at approximately 02:39, Officers J. Torrecillas and J. Gruba were dispatched to Rick's Bar in response to a battery incident. Upon arrival, Officer Torrecillas was approached by several people who informed him that Officer Gruba was dealing with a suspect around the corner. Officer Torrecillas found Officer Gruba trying to speak to Joel Jensen, the arrestee, but Shane Ellestad, another arrestee, and Jensen were continuously yelling at Officer Gruba. Officer Torrecillas instructed Ellestad to step away and speak with him. Ellestad's speech was slurred, and Officer Torrecillas had difficulty understanding him. A witness, Jason Bystol, mentioned that Jensen and Ellestad had been involved in an altercation at the bar and were asked to leave. Despite warnings, Ellestad repeatedly approached Jensen, who swatted him away. Officer Torrecillas told Ellestad to back up, but he didn't comply. Ellestad was told he wasn't being detained but was free to leave, yet he returned to the scene and continued to approach Jensen. After several attempts to get Ellestad to back up, Officer Torrecillas warned that he would handcuff him for resisting if he approached Jensen again. When Ellestad attempted to approach Jensen once more, Officer Torrecillas placed his hand on Jensen's chest to back him up. Jensen threatened to defend himself if touched again. Officer Torrecillas then directed Ellestad to place his hands behind his back for handcuffing, but Ellestad resisted, pulling away and refusing to comply. Officer Torrecillas restrained Ellestad on the ground with the help of other officers, and Ellestad was subsequently transported to the emergency room for right knee pain. After being cleared from the emergency room, Ellestad was transported to the Monroe County Detention Center. While at the hospital, Ellestad made a spontaneous statement indicating he was not trying to interfere with the investigation but wanted to ask Jensen about the alleged punch. Shane Ellestad was charged with resisting an officer without violence (F.5.5. 843.02) for obstructing and opposing Officer Gruba's and Officer Torrecillas's verbal commands during the battery investigation. Jensen was separately arrested by Officer Gruba on other charges related to case number 23-003690.
