On June 11th, 2023 at approximately 1:33 AM, Officer Rutkowski and Lombardo of the Hoboken Police Department conducted a motor vehicle stop in the area of the 1500 block of Washington Street in Hoboken, NJ, for several moving violations. Officer Rutkowski observed the vehicle in question fail to maintain its lane, disregard a traffic control device, and fail to stop for a stop sign. After conducting the stop, Officer Rutkowski made contact with the driver, Ms. Diana Noriega, who reeked of an alcoholic beverage. After admitting consumption to the officer, she stated it was her brother’s birthday and she had finished drinking Sangria approximately thirty minutes prior. Officer Rutkowski then conducted several field sobriety tests with Diana to which she failed each. Diana was placed under arrest after begging officers to not arrest her for fear of it impacting her ability to become a police officer. Officers later searched her vehicle for intoxicants and located a half-empty bottle of Herradura Tequila under the front passenger seat. Once Diana was processed, she provided samples of her breath which yielded a BAC test result of 0.13% BAC. She was issued citations for driving while intoxicated, failure to observe traffic control device, failure to stop at stop sign, reckless driving, and open container in a motor vehicle.
