What is a "Terry Stop"? In this 4th Amendment case study, an officer requests identification without meeting the legal standard of Reasonable Articulable Suspicion (RAS). We examine the real-life application of the right to remain silent and the legal requirements for a mandatory ID. Most people think if a cop asks for ID, you just have to hand it over, but the Constitution actually says otherwise. A 'Terry Stop', which comes from the Supreme Court case Terry v. Ohio, basically means a cop can only legally detain you if they have Reasonable Articulable Suspicion (RAS) that you’ve committed a crime, are in the middle of one, or are about to start one. The bottom line is that if there's no RAS, it’s just a consensual encounter and you’re technically free to walk away. If there’s no crime, then 'because I asked' simply isn't a legal reason for them to demand your papers. The trap here is that officers often use these 'investigatory stops' just to fish for info, so knowing the difference between a polite request and a lawful command is really the only way to keep your 4th Amendment rights intact.
