While walking back to his patrol car, he saw a gray 2018 Toyota RAV4 speeding south on Broad Avenue. Carley got into his patrol car and had to reach about 70 MPH in a 25 MPH zone to catch up. He stopped the vehicle near Broad Avenue and Grand Avenue in nearby Ridgefield. Carley approached the driver, who was identified as Nicole Vasquez. She said she had come from Edgewater, that they were in Englewood, and that she had not consumed much alcohol that night. As he spoke with her, Carley smelled alcohol and noticed other signs of impairment. Captain John Gasparovich arrived soon after, and Nicole was asked to leave the vehicle and complete field sobriety tests. Gasparovich began with the Horizontal Gaze Nystagmus (HGN) test. He observed a lack of smooth pursuit, clear and sustained nystagmus at maximum deviation, and the onset of nystagmus before 45 degrees. Nicole then took the Walk and Turn test. She failed to touch heel-to-toe on every step, turned incorrectly, and took the wrong number of steps. During the One Leg Stand test, she did not raise her foot properly and put it down before the test ended. Her speeding, the smell of alcohol, her admission that she had been drinking, and her poor performance on the sobriety tests led to her arrest for DWI. Her vehicle was impounded for 12 hours under John’s Law. Nicole was taken to the Palisades Park Police Department for processing. At the station, officers read Nicole the Standard Statement for Motor Vehicle Operators. She refused to provide breath samples. After waiving her Miranda rights, she admitted drinking wine at Aumm Aumm Pizzeria in Englewood earlier that evening. She was later released while awaiting her court appearance. Nicole received four citations: Operating under the influence (39:4-50) Refusal to submit to chemical test (39:4-50.4A) Consent to take samples of breath (39:4-50.2) Careless driving (39:4-97) Court records show that Nicole pleaded guilty to operating under the influence on May 9, 2024. The careless driving charge was reduced to unsafe operation (39:4-97.2). Under the terms of her convictions, she spent 12 hours at an intoxicated driver resource center, used an ignition interlock device for three months, and paid $1,180 in fines. The other two citations were dismissed through a plea agreement. If you enjoyed this BodyCamBust video.
