On March 29, 2025, Las Cruces Police Officers responded to a single car motor vehicle accident with airbag deployment. Officer Loya arrived first and made contact with a 21-year-old woman, who was still sitting in the driver's seat of the damaged vehicle. She initially tried to convince officers that she was not the driver of the vehicle. Her story about how much alcohol she consumed fluctuated several times. She was asked to perform standardized field sobriety tests, but refused to complete the one-leg stand test. She was placed under arrest for Driving While Under the Influence of Liquor (DWI). After being read the New Mexico Implied Consent Act Warning, she refused to provide a breath sample, thus elevating her charge to Aggravated DWI. Numerous open containers were found in the vehicle, but she received no additional charges. Her case is still open and all suspects are presumed to be innocent until proven guilty in a court of law.
