On May 27, 2023, Whatcom County Sheriff's Deputy Hentz stopped a vehicle for doing 64 miles per hour (MPH) in a 50-mph zone. The vehicle contained 4 women returning from a concert in Seattle. Deputy Hentz alleges that he could smell alcohol on the breath of the driver, who admitted that she had consumed alcohol. She was asked to step out of the vehicle in order to perform standardized field sobriety exercises. After completing the Horizontal Gaze Nystagmus (HGN) and the Walk and Turn Test, she was asked to submit to a preliminary breath test (PBT), which she initially refused. She was placed under arrest, handcuffed, and placed in the back of the patrol vehicle. Deputy Hentz and Deputy Shelton then attempted to see if a sober driver could drive the vehicle home. The driver's mother, who was sitting in the back seat, agreed to take a PBT. She blew a 0.00% BAC. One of the passengers in the vehicle convinced the driver to submit to a PBT and the result was 0.081%. At the jail, the driver blew into the evidentiary breath testing (EBT) device and the result was 0.091%
