An update on the case of Carlos Bernal. The Bogota, New Jersey gym owner who was arrested on the sidewalk outside his own business on September 11, 2020, after he gave officers his name and date of birth but declined to tell them what city he lived in. He was charged with disorderly conduct, found NOT GUILTY at trial, and then filed a federal civil rights lawsuit against Officer Lewis Duenas, Sergeant Geoffrey Cole, and the Borough of Bogota. That lawsuit, Carlos Bernal v. Borough of Bogota, et al., has now settled. The Borough agreed to pay $85,000, with no admission of liability. Settlement amounts in cases where a government agency is a defendant are matters of public record under New Jersey law.
