GRAND FORKS, ND - At 1:27AM on January 23rd, 2020, a University of North Dakota Police Officer observed a driver swerving on the road, taking a right turn in a straight only lane and almost hitting a plow truck at an intersection. The officer asked how much the suspect had had to drink in the night whereupon he showed him a bottle of water. While exiting the vehicle, the officer observed that the suspect slipped in his seat. Outside of the vehicle, the officer asked the suspect if he had any weapons on him. The suspect said he did not have any weapons, but offered for the officers to take his cellphone and wallet. As the lead officer returned to his patrol car, the second officer observed the suspect place something into his mouth, but did not investigate. The second officer searched the suspect's person and did not find anything illegal in his possession. The suspect then told the officer that he was scared and was on the local unversity's golf team. The suspect was asked if he had any physical impairments that would affect him in performing field sobriety tests. The suspect claimed that he had an unrelated dirt bike accident, but confirmed that nothing would adversely affect him in performing the tests. During the horizontal gaze nystagmus test (out of frame, redacted), the suspect was unable to follow the pen smoothly and the officer observed jerking movement at maximum deviation. The officer next instructed the suspect on how to perform the walk-and-turn test. The suspect asked the officer if he had to take nine steps which the officer affirmed. The suspect was observed being unable to step on the ground without losing balance and pivoted on one leg instead of taking small steps as instructed. The suspect was also swaying throughout the exercise with his arms slightly extended for balance. During the one leg stand test, the suspect was unable to balance without extending his arms out for assistance. While counting, the suspect repeatedly placed his foot on the ground in order to reestablish balance. Following the tests, the suspect told the officers that he was on the local university's golf team and was then taken into custody. After the officers had a brief conversation on what they had observed, the lead officer read to the suspect the North Dakota Complied Consent statement. Following the statement, the officer asked the suspect to open his mouth and observed what he thought was tobacco. The suspect stated that what he had in his mouth was not tobacco to which the officer told the suspect to reopen his mouth. The officer then ordered the suspect to spit out the penny located in his mouth. After spitting out the penny, the suspect once again told the officers that he was on the golf team of the local university and that he had worked his whole life to be where he was. The officer then administered a breathalyzer test. The suspect blew a .185% BrAC which was over twice the legal limit to operate a vehicle in North Dakota. The officer then arrested the suspect for driving under the influence (DUI) and began reading him his Miranda rights. The suspect responded by saying, "My whole life is ruined."
