On December 17, 2023, Las Cruces Police Officer Lopez observed a vehicle hit the curb while making a right turn. He initiated a traffic stop on the vehicle and observed an open container of alcohol when he approached the vehicle. The 22 year-old driver did not have her license in her possession, so Officer Lopez wrote down her name and date of birth and went back to his patrol vehicle to run her information on his computer. When he returned back to her vehicle, the open container was no longer there. She was asked to step out of the vehicle in order to perform standardized field sobriety tests. She was subsequently arrested for DUI because she refused to submit breath samples, her charge was upgraded to aggravated DUI. After processing at the police station, she was transported to the County Jail, while Christmas music was playing in the officer's patrol vehicle.
