GRAND FORKS, ND - At 2:13AM on February 22nd, 2020, University of North Dakota Police observed a driver crossing the double yellow lines on campus. The officer begins investigating the suspect and finds out that she is leaving from a commericial. The suspect struggled communicating with the officer what types of commercials she was working for businesses. When asked how much the suspect has had to drink she responded, "I haven't had anything." The officer then asked the suspect to step out of the vehicle and onto the sidewalk. The officer asked the suspect if she would not mind if she would perform a field sobriety test to which she responded, "No. I am completely fine." The suspect told the officer that she had taken no medications nor had any physical impairments that would hinder her performance in the tests. The officer asked the suspect to spit out a mint prior to starting the tests. The officer observed distinct nystagmus at maximum deviation and that the suspect was unable to smoothly follow his finger during the horizontal gaze nystagmus test. The suspect apologized that her contacts were dry which may have adversely affected her performance in the exercise. Following the test, the officer moved the suspect to the backseat after the suspect told him that her back problems would affect her mobility. The secondary officer told the lead officer that he observed an alcoholic beverage in the backseat of the suspect's vehicle. The officer chose to forgo the finger count test due to the suspect's alleged medical issues. The officer then had the suspect recite the alphabet without singing. The officer observed the suspect slur her speech on the letter, "M." The suspect then proceeded to pass both the counting test and the partial alphabet test. The officer then read the North Dakota implied consent advisory to the suspect whereupon she declined to blow into a breathalyzer. The suspect then proceeded on to tell the officer of all her responsibilities in her home life. The officer let the suspect know that he pulled her over due to her driving habits and that he decided to perform a screening test due to an empty alcoholic beverage container in her car. The suspect was oblivious to this fact and responded, "I have no clue." The officer offered to read the advisory statement again, but the suspect continued to tell the officer that she needed to go home to her children. The suspect continued to maintain her innocence while refusing the screening test. Following the formal refusal, the officer stepped out of his cruiser and proceeded to arrest the suspect. The suspect began crying and letting the officers become aware of even more issues and personal details in her life that culminated in where she was now. Eventually the suspect relented and was arrested for driving under the influence (DUI). After the suspect was handcuffed from behind the back, the officer placed the handcuffs in front of her such that she felt more comfortable.
