GERMANTOWN, WI - On January 12th, 2020 at 6:14PM, Germantown Police responded to a call regarding a vehicle on the side of the road. Upon arrival, the responding officer began speaking to the driver and sole occupant of the vehicle. The officer observed the suspect to have glossy eyes and slurred speech with empty alcoholic beverage containers on the passenger side floorboard. The suspect claimed that he had just recently left a nearby park following a failed Pokémon Go raid before losing control and sliding into a ditch. A secondary officer asked the suspect if he had been drinking to which he affirmed. The suspect was then asked to step out of the vehicle to which he obliged. After exiting the vehicle, the suspect consented to performing field sobriety tests. During the horizontal gaze nystagmus test, the officer observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and nystagmus prior to the onset of 45 degrees in both eyes. The officer did not observe vertical nystagmus. During the walk-and-turn test, the suspect did not touch heel to toe on several steps, used his arms for balance, stepped off line, could not keep balance, and stopped walking during the exercise. During the one leg stand test, the suspect raised his foot approximately three inches as compared to the six inches instructed, did not keep his foot parallel with the ground, and placed his foot down three times. Due to safety reasons, the test was stopped. The suspect was then asked to provide a preliminary breath test to which he refused. The suspect was then arrested for operating while intoxicated (OWI). While being handcuffed, the suspect's wife returned on scene prompting the suspect to yell, "fight them," in reference to the police. Once in custody and in the patrol car, the suspect was then read the Informing the Accused form whereupon he was asked to consent to an evidentiary chemical breath test. The suspect initally refused, then changed his mind and agreed. After the officer informed the suspect that the refusal was already documented, the suspect claimed that he would pursue legal action against the City of Germantown. Eventually a warrant was obtained and a blood draw was performed. The results yielded a blood alcohol concentration of .138 g/100mL.
