GRAND FORKS, ND - At 1:33AM on March 1st, 2020, University of North Dakota Police pulled over a driver around the 2000 block of Demers Ave. The driver of the vehicle crossed over the center median and stopped in oncoming traffic. The officer approached the vehicle and began asking for proof of insurance and registration. During the stop, the officer could smell an odor of an alcoholic beverage coming from the vehicle. Because the suspect also had bloodshot watery eyes, the officer asked the driver to step out of the vehicle. Before the start of the standardized field sobriety test (SFST), the officer asked the suspect if he had any head injuries to which he replied that he had a concussion while in Africa. The suspect then claimed that he was from Liberia and had been in the United States for five years. The suspect confirmed that he could effectively communicate in English. During the horizontal gaze nystagmus test, the suspect did not display smooth tracking and displayed nystagmus at maximum deviation in both eyes. The suspect did not have issues while performing the walk and turn test. For the one leg stand test, the suspect did not raise his foot the full six inches off the ground as instructed and did not look at his foot while balancing. Following the tests, the suspect was placed in the patrol vehicle and asked to remove gum from his mouth. After three minutes, the suspect consented to a screening test where he registered .142% breath alcohol content (BrAC). At this time, he was subsequently arrested for driving under the influence, or DUI.
