FERNANDINA BEACH, FL - At 12:24AM on January 14th, 2020, a Fernandina Beach police officer pulled over a man going 49 in a 35 MPH zone. Not long after confronting the suspect, the officer questioned whether the man had been drinking due to his slurred speech. The suspect admitted to being a bartender at a local establishment and having had one beer. A strong presence of the odor of alcohol was detected by the officer. Once the suspect's information was verified, the driver was asked to step out of the vehicle and was informed that he is under investigation for driving under the influence (DUI). He was then advised of his rights. The suspect then informed the officer that he actually had two beers throughout the day which was not the same as previously stated right before the testing commenced. During the horizontal gaze nystagmus (HGN) test, the suspect was unable to smoothly follow the officer's pen with his eyes. Distinct jerking was noted while the suspect's eyes were at maximum deviation. Following the HGN test, the man was instructed to walk a straight line. He repeatedly missed touching heel-to-toe in his steps and performed an improper turn after being instructed on how to properly turn. The suspect was unable to properly perform the one leg stand and placed his elevated foot on the ground several times and could not balance properly throughout the exercise. During the Romberg balance test, the suspect was swaying and had difficulty leaning his head back as instructed. When asked to recite the alphabet in a non-rhyming fashion, the suspect failed to do so and instead admitted to having to resort to rhyming because there is no other way to do so. Finally, during the finger-to-nose test, the suspect failed to remove his hand from his nose on the first request. This was explained to the suspect beforehand and he failed to follow these instructions. Following the series of tests, the suspect was once again asked how much he had had to drink and told the officer that he had four beers and one shot. This was more than the two previous times when asked this question. At the conclusion of the investigation, the officer arrested the suspect for (DUI) whereupon he admitted that this was his second DUI offense in eight years. After further investigation, the suspect was only charged with DUI in March 2012, but was not convicted.
