#bodycam #shoplifting #legalanalysis On an afternoon the footage does not date, a grocery store employee tells police that a shopper left her cart behind, walked out with a six pack of wine and two more bottles, answered a request for a receipt with "leave me alone," and got into a waiting car. Officers stop that car at the roadside. The rear passenger is told she is detained for a theft, hears a Miranda warning, and is then told she is under arrest. After an appeal to honesty she confirms that body care items in the car came from a second store, and the officer offers a summons instead of jail. The driver, who says she only gave a ride, watches officers go through her entire vehicle. Can a store employee's report alone justify stopping a car? Is a Miranda waiver valid if the person never confirms she understands the warning? And can police search a driver's whole car, including her own bag, because of what a passenger is accused of taking? The case status was unknown at the time of this analysis.
