On April 7, 2023, New Mexico State Police (NWSP) Trooper Avina observed a vehicle swerving over the lane lines painted in the roadway. He initiated a traffic stop on the vehicle, which was occupied by two women. The driver was asked to step out of the vehicle and when Trooper Avina told her that he could smell alcohol, she readily admitted that she had been drinking earlier in the night. She was asked to perform standardized field sobriety tests and was subsequently arrested for Driving While Under the Influence of Liquor (DWI) and Failure to Maintain Lanes. She was transported to the NMSP station, where she submitted to an evidential breath test. The result was 0.14% BAC. Online court records show she pleaded no contest to the DWI charge and the Failure to Maintain Lanes charge was dismissed. She entered a deferral program where the conviction was dismissed once she completed court ordered DWI school and community service.
