Per Incident Report: On July 5, 2023, at around 8:54 am, I was on duty and patrolling in Lee County, Florida. I was northbound on I-75, approaching the 119-mile marker in the inside left lane. As I was traveling with the flow of traffic, I noticed a yellow vehicle about 1/5 mile ahead of me. The vehicle aggressively switched lanes, moving from the inside left lane to the outside right lane in an attempt to overtake other vehicles. This maneuver brought the yellow vehicle very close to other cars, almost rear-ending a dark pickup truck in the center lane. The yellow vehicle then passed the pickup, nearly making contact with its right rear as it moved into the outside lane. Subsequently, the yellow vehicle accelerated to a speed I estimated to be over 100 miles per hour (MPH), significantly exceeding the posted speed limit of 70 mph. The yellow vehicle then caught up to a red/maroon sedan in the outside lane and abruptly hit the brakes to avoid a collision. It began tailgating the sedan because it couldn't switch to the center lane due to other traffic. The yellow vehicle then made aggressive lane changes, cutting across all lanes to the left and accelerating once again. The driver's behavior demonstrated a reckless disregard for the safety of others, with rapid lane changes, tailgating, and excessive speeds. Based on the rapid distance between the yellow vehicle's taillights and the cars it had overtaken, I estimated its speed to be over 100 mph. Due to the dangerous driving pattern, I decided to accelerate to catch up to the vehicle. It's important to note that I made these observations without activating my emergency lights or sirens. I managed to approach the yellow vehicle from behind, still in the inside left lane, near the 121-mile marker. The vehicle, identified as a yellow Fiat 500 with Florida Tag GSVL36, was clocked at approximately 97 mph in a 70 mph zone before I activated my emergency lights and sirens. Given the aggressive driving behavior and high-speed overtaking, it was clear that the driver showed a willful and reckless disregard for the safety of others. Consequently, I initiated a traffic stop by activating my emergency lights. Upon seeing my lights, the Fiat pulled over onto the left shoulder of northbound I-75, approximately 1 mile south of the 123-mile marker exit toward CR-850 (Corkscrew Rd). As I exited my patrol vehicle and approached the Fiat's driver-side window, I observed a Hispanic male in the driver's seat as the sole occupant. Before I could reach the driver's window, he suddenly accelerated and fled from the traffic stop. I hurried back to my patrol vehicle and began pursuing the Fiat, notifying the Fort Myers Regional Communication Center (FMRCC) of the situation and my intention to pursue the vehicle. Maintaining visual contact with the Fiat, I witnessed it take the first exit onto Corkscrew Rd. The Fiat maneuvered over a curb to bypass traffic halted at a red light on the northbound exit ramp. This action caused damage to the right front tire, emitting smoke. I surmised that the tire was damaged due to the curb impact. The Fiat continued onto Corkscrew Rd, heading east toward Ben Hill Griffin Pkwy. With lights and sirens still active, I closed the gap between us. Navigating through heavy morning traffic within a construction zone, where the outside lane was cordoned off, the Fiat was traveling at speeds of 60-70 mph, weaving between vehicles and barricades. Upon passing Ben Hill Griffin Pkwy, we proceeded east on Corkscrew Rd. As we neared Willow Bend Ct, the construction area became fully obstructed, funneling all traffic into a single lane. With no escape route available due to the heavy traffic, the driver forcefully opened his door, veered to the right, and became ensnared in construction gravel. He abandoned the vehicle and attempted to flee on foot. I followed on foot, initiating a pursuit. The driver, a Hispanic male donning a black shirt, white shorts, and sandals, fled toward the construction zone parallel to Corkscrew Rd. Despite my repeated commands to halt, I warned him that failing to comply would result in deploying my Taser. I seized his left wrist and arm, employing a takedown technique that successfully brought him to the ground, with his hands behind his back. A bystander, a retired law enforcement officer, was present and aided me in securing the subject. Trooper P. Kirk (ID 1337) arrived about 30 seconds later, and together we handcuffed the subject safely. He was apprehended at around 9:00 am. The driver's identity was confirmed as Noel Dejesus Resto Jr. Resto stated that he fled due to multiple active warrants. A check of his information on Florida Crime and Information Center (FCIC) and National Crime and Information Center (NCIC) revealed one active warrant from Collier County, Florida and another active warrant from Lee County, Florida. Both warrants were verified.
