Ms. Finnegan was charged with a single count of Child Neglect under Florida Statute 827.03(2)(D) after leaving her minor child, Michael, asleep in a parked car outside Smiley's bar while she went inside to join her husband. Her husband was also originally charged with child neglect, but his charge was later dropped. Law enforcement responded to a 9-1-1 text and found the child in the vehicle. The defense filed a Sworn Motion to Dismiss arguing the undisputed facts do not establish a prima facie case of guilt, emphasizing the child was checked on multiple times, was never in distress, and was comfortable and sleeping with the A/C running throughout. Timeline from Motion to Dismiss: 9:53 PM — Ms. Finnegan arrives at Smiley's, parks directly in front of the entrance. Michael is asleep in the car with A/C running. ~10:00 PM — Bartender places a drink in front of Ms. Finnegan. 10:03 PM — Ms. Finnegan takes her first sip. 10:05 PM — A friend goes out to check on Michael (~12 min after arrival). Captured on surveillance. Shortly after — Friend returns, gives thumbs up that Michael is ok. Captured on surveillance. 10:10 PM — Ms. Finnegan takes her second sip; drink is still more than half full. This would be her last of the night. 10:11 PM — Ms. Finnegan checks on Michael herself (~6 min after friend checked). Captured on surveillance. 10:23 PM — Ms. Finnegan checks on Michael again (~12 min after previous check). Captured on surveillance. 10:28 PM — Law enforcement arrives responding to a 9-1-1 text. They maintain a visual on the vehicle but do not approach immediately. 10:31 PM — Law enforcement approaches the car. 10:35 PM — Ms. Finnegan notices LE outside, goes to check on Michael and see what's happening. Captured on surveillance. This is ~12 min after her last check. Key defense points: Michael was checked on at 10:05, 10:11, 10:23, and 10:35. The longest he was left unattended was 12 minutes; the shortest was 6 minutes. At no point was the child in distress — bodycam footage shows him comfortable and sleeping. Ms. Finnegan had fewer than two sips of one drink during the entire 42-minute window. Her husband's child neglect charge was dropped.
