#news #police #arrest #cops Offenses: DUI - Adult beverages - Less Safe Failure to Maintain Lane Report: On February 18th 2022, Officer was patrolling the area of Epps Bridge Parkway when I observed the vehicle in front of me commit a traffic violation. Officer observed a Black Ford Escape fail to maintain its lane two times prior to exiting the ramp. I conducted a traffic stop using my lights and siren and came to a stop at the intersection of Epps Bridge Parkway and the Abbey West apartment complex. Officer conducted a passenger side approach on the vehicle and identified the driver as Emily Hester. He explained to Hester that he pulled her over for failure to maintain lane and returned to his car with her identification. After everything came back valid I approached Hester and asked her if she had anything to drink prior to driving because I detected the odor of alcoholic beverages coming from her side of the vehicle. Hester stated that she was a server at Longhorn steak house and that after work she had one strawberry margarita. Officer proceeded to ask Hester if she would be willing to participate in the Standardized Field Sobriety Test to determine whether she was able to operate a motor vehicle and Hester stated she would. Horizontal Gaze Nystagmus Test I began the Standardized Field Sobriety Testing with observing Nystagmus in the Eyes. I asked Hester if she had any prior head injuries which she advised no. I then asked her if she wore contacts/glasses, which she stated no. I then explained that I needed her to follow the tip of my pen with her eyes, and eyes only. I told Hester that she could not move her head. I asked Hester if she understood, she stated yes. As I observed the defendant's eyes, He noticed: A lack of smooth pursuit, Distinct and sustained nystagmus at maximum deviation, Onset Prior to 45 degrees It is important to note that I also checked Hester's eyes for Vertical Nystagmus and it was present, this indicated that the amount of alcohol that she had consumed was a high amount for her. At the start of my evaluation I noticed that Hester moved her head several times during the evaluation and prior to reaching maximum deviation the nystagmus began to show. After observing a lack of smooth pursuit, I continued with distinct and sustained Nystagmus at max deviation which I observed in both of her eyes. I also observed Nystagmus in Hester's eyes onset prior to 45 degrees. Walk and Turn Test I began my instructions by informing Hester to place her left foot first on the (imaginary) line, with her right foot in front of so. I asked if she had any prior hip or leg injuries that could prevent her from completing this task, she stated no. I demonstrated and Hester momentarily got into the stance. I instructed her to keep her hands by her side and to keep her feet heel to toe.
