In July 2021, a young man named Luke was exploring Jacumba Hot Springs, California, a small desert town on the U.S.-Mexico border, photographing abandoned buildings and old railroad tracks. Minutes after leaving town, he was pulled over and surrounded by multiple U.S. Border Patrol agents who said they had probable cause to suspect him of alien smuggling. What followed was a tense roadside encounter, recorded on Luke’s own phone, that raised serious questions about the Fourth Amendment, the First Amendment, and how far Customs and Border Protection (CBP) authority really reaches near the border. In this video, we break down the stop moment by moment and explain the law behind it. We look at the difference between reasonable suspicion and probable cause, and why being near the border doesn’t give agents unlimited power to pull people over. We cover your right to record police and federal agents in public, and why an on-duty officer has no expectation of privacy. We also explain whether an agent legally has to give you a badge number, how California’s new officer ID laws are changing that, and the Border Patrol K-9 trained to detect “concealed humans,” including the obvious question of what happens when the driver is still sitting in the car. When Luke asks for the reason he was stopped, he’s told the agents already explained it. When he offers to show the agent a copy of the Constitution, the agent replies that he’s “not interested.” Luke refuses a vehicle search, and a K-9 unit is called to the scene. We also cover what Luke says happened after the recording ended, including his allegations about the search, his phone, and the Freedom of Information Act (FOIA) request he filed for the dashcam footage. This video is for educational and informational purposes, to help viewers understand their constitutional rights during traffic stops and police encounters. Events after the recording ended are based on Luke’s own account and are presented as allegations. CBP has not publicly explained the reason for the stop. 👉 Subscribe for more real police bodycam footage, arrests, and criminal investigations.
