On May 18, 2023, a police officer conducted a traffic stop on a black Nissan sedan in the 300 block of N Tuttle Ave in Sarasota, Florida. The reason for the stop was the registered owner is having a suspended driver's license. During the stop, the officer requested the subject of his driver's license, insurance, and registration, but he refused to answer any questions, insisting on having his lawyer present. When asked to exit the vehicle, he continued to refuse, stating he would only comply in the presence of his lawyer. Additional officers arrived, and even after repeated orders to exit the vehicle, the driver remained uncooperative. Only after completing a phone call did, he finally complies. The officer concluded that the subject deliberate noncompliance obstructed the performance of his lawful duty. During further investigation, it was discovered that the driver had two prior suspensions on his driver's license. The first suspension occurred on April 29, 2023, as a result of his refusal to submit to a breath, urine, or blood test (Citation/Case #: AHS5JOCE). Subsequently, on May 5, 2023, his license was indefinitely canceled. Furthermore, it was observed during the traffic stop that he did not possess a driver's license, only an identification card, indicating his awareness of the license cancellation. Consequently, the driver was arrested without any additional incidents and transported to Sarasota County Jail. He now faces charges of resisting an officer without violence and driving with a suspended license for the third or subsequent time, which is classified as a felony due to his prior refusal to submit to a breath, urine, or blood test.
