Layota Thomas was pulled over for driving without her headlights on in the rain at night. Officer Kemp noticed a small opened bottle of liquor in plain view when he approached the car. He pulled her out of the car and put her through field sobriety testing which she failed. Layota was asked to provide breath samples back at the police station, but was unable to do so. She failed to give breath samples 4 times before refusing to continue.
