On April 30th, 2023, at approximately 17:23, Officer Wild, of the Florida Fish and Wildlife Conservation Commission (FWC), was on patrol on Lake Boca. While on patrol, a black and yellow Personal Watercraft was observed jumping wake and violating the speed and wake zone on the sandbar, prompting Officer Wild to initiate a vessel stop. Upon making contact with the operator and owner, [REDACTED] Officer Wild immediately observed signs of impairment including slurred speech, glossy eyes, sunburned skin, and the odor of alcohol. Officer Wild explained the reason for the stop and began asking for registration, conducting a boating safety inspection, and requesting all required safety equipment. [REDACTED] had difficulty locating his safety equipment, presenting a sealed container when asked for a sound device. Despite being asked to produce it again, [REDACTED] insisted on opening a new container. As Officer Wild continued his observations, he noted [REDACTED]'s increasing agitation and reluctance to cooperate. Due to the observed signs of impairment, Officer Wild asked [REDACTED] to perform Seated Field Sobriety Tasks (SFST) on the vessel to ensure safe operation. Initially agreeing, [REDACTED] then became agitated, expressing a desire for legal representation but eventually complied. During the SFST, Officer Wild observed several indicators of impairment. [REDACTED] displayed resistance and profanity during the SFST, ultimately refusing to continue and expressing disdain for law enforcement. Despite Officer Wild's attempts to give [REDACTED] every opportunity to demonstrate his ability to operate the vessel safely, [REDACTED] remained uncooperative. Upon transitioning to the arrest phase, Officer Wild attempted to restrain [REDACTED], who resisted, necessitating assistance from other FWC officers. Throughout the altercation, [REDACTED] continued to make vulgar remarks. Following the arrest, [REDACTED] displayed further defiance and hostility, refusing aid from Palm Beach County Fire and Rescue and making remarks towards the officers and their spouses. [REDACTED] was transported to Palm Beach County Jail and charged with boating while impaired, resisting arrest without violence, and refusal to submit to a breath test. Additionally, infraction citations were issued for violating the slow speed zone in Lake Boca.
