Body Cam Video Of Handcuffed Man Escape Custody While Police Watch - On Saturday, May 21, 2022, Officer E. Cernuto and Officer G. Spirito of the Florida Fish and Wildlife Conservation Commission (FWC) were conducting vessel patrol along the Intracoastal Waterway. During this patrol, they observed a vessel (FL0463SU) heading northbound with its bow ladder dragging in the water. Body cam footage shows the officers pulling alongside the vessel to inform the captain of the situation and initiate a safety inspection. The officers requested to see the vessel’s safety equipment, and the operator initially produced a throwable flotation device. However, as seen on the police body cam, when asked for the rest of the safety gear, the operator appeared disoriented and opened a hatch that contained empty alcohol cans, which he quickly closed. He then failed to locate the required safety equipment, wandering aimlessly around the boat. The police asked for his identification, and the body cam captured the operator struggling to remove his driver’s license from his wallet. At this point, the officers began to suspect impairment. While continuing the inspection, police noticed the smell of alcohol coming from the operator, and body cam footage shows his eyes appearing bloodshot and glassy. When asked how much he had been drinking, the operator admitted to consuming "probably like three beers." Police also observed a beverage container near his feet. Based on these signs of impairment, the officers requested the operator to step onto their vessel for Seated Standardized Field Sobriety Tasks (SSFSTs). After completing the tasks, which indicated further signs of impairment, the police placed the operator under arrest for Boating Under the Influence (BUI). As captured on the body cam, while seated on the police vessel, the suspect suddenly stood up and leaped over the stern into the Intracoastal Waterway, attempting to flee. The body cam footage shows the officers immediately giving verbal commands for him to stop, which he ignored. The officers maneuvered their patrol vessel to pursue him, and Officer Cernuto jumped into the water in an attempt to recapture the suspect. Officer Spirito remained on the patrol vessel due to the increasingly belligerent behavior of the remaining passengers on the suspect's vessel. Despite repeated verbal commands to stop, the suspect continued to swim toward the shore. Police body cam footage shows the officer warning the suspect that a Taser would be used if he did not comply. When the suspect ignored these warnings and continued to flee, the officer deployed a Taser. The initial deployment was unsuccessful, but after further pursuit, the officer deployed a second Taser cartridge, successfully incapacitating the suspect, as seen on the body cam. Officers Godward and Pecko arrived on the scene to assist with securing the suspect. The suspect was then transported to a hospital for medical clearance. Body cam footage captured the suspect refusing to provide a blood sample to test for alcohol and controlled substances, despite being read Implied Consent. He repeatedly asked police how long marijuana stays in the system and admitted he might have smoked two weeks prior. After continuing to refuse the blood test, the refusal was logged, and he was transported to Martin County Jail. The suspect was charged with Escape, Resisting Arrest Without Violence, and Boating Under the Influence (BUI). All actions, including the pursuit, arrest, and suspect's behavior, were recorded on police body cam footage and filed as part of the official case report.
