On October 26, 2024, at approximately 11:40pm, while assigned to the town of Lake Park and conducting a business residence check in Lakeshore Park, an officer observed a black male, later identified as Mark, lingering in the park after hours. Sergeant Fox informed Mark that the park was closed after 10pm, as indicated by the signs posted at the four corners of the park, and instructed him to leave the area. Mark became passively resistant and argumentative regarding the lawful command. Due to his passive resistance, he was given a lawful command to provide identification so he could be trespassed from the park. Mark disregarded this command and attempted to walk away but was subsequently stopped and detained. Mark continued to exhibit unusual behavior and was uncooperative with multiple requests for identification. During a pat-down, a card bearing Mark's name was located. A search of his name through the law enforcement database returned no results. When asked if he had ever been issued identification or a driver's license in the state of Florida, Mark responded with an unusual statement, saying, "I am always running into you guys." The officer explained to Mark that in order to issue the trespass document, he needed to properly identify himself. Mark was asked for his full Social Security number to confirm his identity but refused to provide it. After multiple opportunities to comply, probable cause existed for the arrest of Mark for violating Florida state statute on resisting an officer without violence. He was given several lawful commands and opportunities to comply with identification requirements necessary for issuing a trespass order.
