Deputies report: On 12-26-2024 at approximately 2328 hours, I was traveling north on Coors Blvd NW and observed a vehicle traveling south on Coors Blvd at what appeared to be a high rate of speed. My radar showed the vehicle was traveling at 80 miles per hour in a 45 mile per hour zone. I turned around to catch up to the vehicle and noticed the truck was driving half way in the number 1 lane, and half way in the number two lane for an extended period of time, therefore failing to maintain its lane. I caught up to the vehicle as it began taking the ramp from south Coors to Interstate 40 east. I conducted a traffic stop and the vehicle came to a stop on the ramp. I approached the vehicle and made contact with the driver who was identified as Truitt Bushnell. Truitt had rolled down all the windows of the vehicle prior to me approaching. I asked Truitt why he was driving that way and he responded by saying "I might not be a good driver". I explained to Truitt why I stopped him and he handed me his driver's license and Albuquerque Police Department commission card. I asked where he was coming from and he advised he was coming from a buddies house. I noticed that Truitt had bloodshot and watery eyes and I began detecting an odor of an alcoholic beverage emitting from inside the vehicle. Truitt stated he was coming from his friends house and had not consumed any alcoholic beverages. I noticed Truitt was breathing heavily and I could see a pulse on his neck beating rapidly. I had Truitt shut his vehicle off and I retrieved the key from him. I returned to my vehicle to make space between his vehicle and mine for Standardized Field Sobriety Tests (SFST's). I then returned to the vehicle and had Truitt exit the vehicle so that I could further my investigation. I noticed after returning to the vehicle that Truitt had gum in his mouth. This was easily noticeable because he was initially chewing his gum at a fast rate. I explained to Truitt my concern for the totality of the circumstances this far tonight. I told him that I was detecting an odor of an alcoholic beverage emitting from inside his vehicle and now I told him that I noticed he was chewing gum. Truitt responded by saying he always chews gum. (chewing gum is often times used to cover up an odor of an alcoholic beverage that emits from a persons facial region). Truitt again denied consuming alcohol this date and stated he didn't know what I was talking about. I asked if he could explain why I was detecting an odor of an alcoholic beverage now emitting from his person and he said because he had cologne on. Truitt and I were face to face and I was detecting an odor of an alcoholic beverage emitting from his facial region as he spoke to me, even while he was chewing gum. I asked Truitt to spit his gum out while we continued speaking and he did as I asked. Truitt was asked if he would be willing to go through SFST's and he stated he could not perform SFST's due to a broken ankle from a gun fight he was in and because of mobility issues in his hips. I asked Truitt if he would be willing to go through alternative testing and he said he would have difficulty with the finger dexterity test because of his hands having previous injuries. Truitt explained that he did not have any recent concussions or TBI's. Truitt was asked what level of education he had and he advised he had a high school diploma. I asked if he knew his alphabet and he said he "roughly" knew it. Truitt was asked to start with the letter "G" and to continue the alphabet until he reached the letter "T" without singing the alphabet. Truitt began: "G-H-I-J-K-L-M-N-O-P-T". Truitt was then asked to start with the number 68 and to count backwards until he reached 53. Truitt did this test properly. The finger dexterity test was instructed and demonstrated. Truitt did this test properly. Following the test, I explained to Truitt that I have been doing this job for a long time and could tell that he had in fact consumed alcohol this evening. I asked how much he consumed and he advised he had not consumed alcohol. I told Truitt that I had a Portable Breath Test (PBT) tool issued to me by the county that he could use to prove me wrong. I asked if he would be willing to prove me wrong by providing a breath sample in the PBT and he responded by saying "no sir". Given the totality of circumstances I believed Truitt to be under the influence of intoxicating liquor or drug, impaired to the slightest degree, and unable to safely operate a motor vehicle. Truitt was placed under arrest for driving under the influence of intoxicating liquor or drug (DWI/DUI). Truitt was read the implied consent advisory in full and refused to be tested, stating he wanted a blood test. I ran the IR8000 and provided Truitt an opportunity to provide a breath sample and he refused by not providing one. Truitt was later transported to PTC where he was booked without further incident.
