It really helps us do original reporting like this. 🔍 Episode Overview: At around 10:45 PM on May 29, 2023, Patrolman Nicholas Brady of the Avalon Police Department saw a white 2016 Jeep leave the Wawa at 2701 Ocean Drive without headlights. He turned around and started to follow the vehicle as it headed west on Avalon Boulevard. Brady pulled the Jeep over on the shoulder and approached the driver, who was identified as Valerie. He told her she had been driving without her lights and asked for her driver’s license and registration. Afterward, he went back to his patrol car. Soon after, Patrolman Anthony DeCesero arrived and told Brady that he had warned Valerie to leave her car parked in the Wawa lot because she might be drunk. She ignored his warning and drove away anyway. Surveillance footage later confirmed DeCesero’s account. Suspecting she was intoxicated, the officers asked Valerie to step out of the vehicle to perform field sobriety tests. Brady started with the Horizontal Gaze Nystagmus (HGN) test. During this, he saw her eyes lacked smooth pursuit, a clear nystagmus at maximum deviation, and nystagmus that began before 45 degrees. Next was the Walk and Turn test. Valerie couldn’t keep her heel properly aligned and didn’t follow instructions while turning, taking too few or too many steps. She also failed the One Leg Stand test, showing poor balance and failing to lift her foot correctly. Because of Brady’s observations, the smell of alcohol, and her inability to do the tests properly, Valerie was placed under arrest. Her vehicle was towed and held for 12 hours under John’s Law. Brady drove her to the police station for processing. She was read her rights but refused to take a breath test. After processing, Valerie was released to another person. She signed a warning form for potential legal trouble. Brady issued her three citations: Operating Under the Influence, Refusal to Take a Chemical Test, and Improper Lighting. On June 2, 2023, Valerie was found guilty of DUI. She spent 12 hours at an alcohol education center and paid $640 in fines. The other two citations were dropped as part of a plea deal.
