Officers responded to a burglary in progress. On scene, Officers found Clowser walking away from the house. He was matching the description of the burglar given to the call taker. White male, wearing a black hoodie, facial tattoos. The officer detained Clowser and then went to speak to the caller and resident of the home. In summary, they had been upstairs in their bedroom sleeping,  when they heard another person inside. The homeowner opened the bedroom door and saw Clowser standing in his hallway. The homeowner asked the person standing at his house "Who the fuck are you?". Clowser turned away and walked out of the home through the front door.  While the homeowner was speaking with Clowser. The female who was in the home called for police assistance. Clowser stated, in summary, that he had thought he was entering his friend Sarah's house. Mr. Clowser admitted, under Miranda, that he had opened the unlocked, but closed, front window on the porch and climbed inside to enter the home. Mr. Clowser stated when confronted by the male homeower, that he had left through the front door and walked away from the home. Mr. Clowser had left his cell phone inside the home of the house he had just broken into. Nothing had been taken from the address. Mr. Clowser was turned away from Summit County Jail for excessive intoxication. He was released to his mother. He was given a summons.  Mr. Clowser was transported to the Summit County Jail. Unfortunately due to his intoxication, the Jail would not take him at that time. He was given a summons for Breaking and entering. He was released to his mother.
