The circumstances around this video are unclear, but starts as officer’s Casteneda and Costilla are attempting to identify a citizen that appears to have had a confrontation with contractors that were hired to make repairs to the property he was renting. In Brown v Texas, The officers did not claim to suspect Brown of any specific misconduct, but tried to Identify the man for suspicious circumstances. When brown refused to identify himself, he was arrested for violation of Texas statute 38.02 Which States: A person commits an offense if he intentionally refuses to give his name, residence address, or date of birth to a peace officer who has lawfully arrested the person and requested the information. “has been lawfully arrested.” is the key point that to this day, many officers are still poorly trained on. Failure to ID is a secondary charge, and cannot be used as a base charge to arrest an individual. Two sets of "rights" are coming into conflict here. The tenants right to quiet enjoyment; and landlord's right and obligation to repair and maintain their own property. Landlords in Texas are required to provide written notice of entry onto the tenant’s premises. However, no notice period is specified under Texas law. 24-48 hours notice before entering a unit is suggested, and based on other states’ models, reasonable times are defined as Monday-Friday between 8am and 6pm. If the work unreasonably interferes with your tenancy, you might be entitled to break your lease, ask for reduction in rent, relocation assistance, or some other type of remedy.
