SCHODACK, NY – On May 12th, 2022 at 11:30PM, a Schodack Police Department Patrolman stopped a vehicle traveling on Route 9 within town limits. The patrolman stopped the suspect at a gas station next door to the police station and approached the vehicle on the driver side. The suspect claimed that he was not doing anything bad, but had drank earlier in the evening. The suspect then began to speak in length regarding his difficult situation in his life while claiming that he was "not a bad guy." Following another lengthy discussion with the secondary patrolman, the suspect was asked to step outside his vehicle to perform field sobriety tests to which he complied. Before beginning the standardized field sobriety test, the patrolman asked the suspect if he always was as erratic as he was currently acting to which he affirmed. For the horizontal gaze nystagmus test, the suspect displayed lack of smooth pursuit and distinct and sustained nystagmus at maximum deviation in both eyes. The test had to be stopped at one point due to concerns with the suspect's balance while performing the exercise. During the walk-and-turn test, the suspect abandoned the instruction phase three separate times due to losing his balance while being told to remain in the starting position. While performing the test, the suspect made an improper turn, used his arms for balance, and performed a series of three steps on more than one occasion instead of taking nine. For the one leg stand test, the suspect swayed while balancing, used his arms for balance, and began hopping on one leg before stopping the test. At the conclusion of the field sobriety tests, the suspect told the secondary patrolman that the last time he had used cocaine was three years ago. The suspect eventually provided a preliminary breath sample which yielded a result of .187% breath alcohol content. The suspect was then arrested and transported to the Schodack Police Department for further processing.
