Officers report: On September 2nd, 2023, I was on patrol in a marked unit, in full uniform, and displaying my badge of office. At approximately 2254 hours, I was dispatched to the Speedway Convenience Store at 2615 E. Main St., Farmington, NM, 87401, in reference to a shoplifter who had battered an employee after being told to leave. The subject was being held by two bystanders who had witnessed the battery, and dispatch was notified. Upon arrival, Officer Boyd was already on scene and was able to place the subject in handcuffs. The subject, whom I recognized to be Derrick Mason, appeared to be highly intoxicated and/or impaired from alcohol or drugs. We tried sitting Derrick up on the curb of the sidewalk, but he continued attempting to kick bystanders on the sidewalk. In an effort to avoid further injuries, we escorted Derrick to the back of my patrol unit, and when he sat in the backseat, he spat on Officer Boyd. He attempted to spit again, after spitting on Ofc. Boyd, so I held his head in a back position so that a spit mask could be applied. While holding his head back, Derrick bit my glove along with the skin of my right ring finger. I was able to get my hand away from Derrick’s grasp, and the spit mask was applied. I spoke with the employee who advised that Derrick had entered the store staggering and attempted to walk out with a 40oz bottle of Steel Reserve brand alcoholic beverage. She then notified another employee so that they could retrieve the bottle from the male and told him to exit the store. The clerk was holding the door open, and Derrick exited the store before walking back towards her and punching her in the face with a closed right fist. She denied any medical attention and wished to pursue charges for the battery. The two bystanders who held Derrick down were Tyrell and Emmitt and they both advised that they had observed Derrick punch the clerk in the face, and Tyrell rushed to help her. He was able to toss Derrick onto the ground and wait for the officer's arrival. Emmitt also observed the battery and helped Tyrell hold Derrick on the ground as he attempted to bite Tyrell and himself. No other injuries were observed or reported on scene. I then went back to try and speak to Derrick to see if he needed medical attention, but he was agitated and began moving his legs as if he was going to start kicking. I held his legs down and began putting on his seatbelt, but he began spitting once more. With particles still exiting the spit mask, I held his head back once more to put the safety belt on. I transported Derrick to the San Juan County Adult Detention Center and he was booked. Derrick was booked for Shoplifting, Battery, and two counts of Battery upon a Peace Officer. He was provided a copy of his Criminal Complaint and trespass notice. No dependents were affected by this arrest.
