EUSTIS, FL - At 10:27PM on January 12th, 2020, a Eustis Police Officer observed a man failing to come to a complete stop at a stoplight. Once pulled over, the suspect proceeded to have an exceedingly difficult time producing his registration. The officer went back to his squad car to verify the information given to him by the suspect. Returning to the suspect's vehicle, the officer observed that the man had an empty container of alcohol in the center console. The officer questioned the suspect on how much he had to drink in the night and why a beer can was in the center console. The suspect admitted to drinking, "not much," and that he was coming back from a party. Shortly after the admission, the officer asked the suspect to step out of the vehicle and if he would be willing to participate in field sobriety tests. The officer asked the suspect if he had any restrictions or limitations that would prevent him from completing the tests. The suspect agreed to taking the tests and that he would not have any issues performing the tests as instructed. For the horizontal gaze nystagmus test, the suspect had to have the instructions repeated before beginning the exercise. Once the test began, the suspect had to be told to keep his head still twice more by the officer as previously instructed. The suspect was unable to follow the officer's pen smoothly and was observed to have a jerking motion in his eyes at maximum deviation. The suspect was observed having difficulties understanding the instructions by the officer during the walk-and-turn test where parts of the exercise had to be repeated. The suspect immediately stumbled on the first step of the test, then proceeded to walk with his steps offset from one another instead of in a straight line as demonstrated. The suspect was observed taking 10 steps both forward and back along with having extended his arms for balance throughout the test. At the conclusion of the test, the suspect stated that he would not have been able to perform the tests sober. After the officer had instructed the suspect to perform a one leg stand test, the suspect started the exercise without prompting. The officer then told the suspect to stop the test before he had been told to do so. The officer then told the suspect to start. The suspect was observed extending his arms out parallel to the ground for balance until counting silently to the number six and stopping. The suspect then asked, "Am I good?" The officer then told the suspect to balance on one leg until told to stop. The suspect apologized then continued to perform the test in the same incorrect manner as before. Once finished, the officer instructed the suspect on the finger to nose test. During the exercise, the suspect had to be reminded to keep his head back and his eyes closed which he was not doing previously. At one point, the suspect stumbled dramatically and had to take several steps out of position to balance himself. Upon completion of this final test, the suspect was taken into custody and charged with driving under the influence (DUI). During the search of his vehicle, the officers found several open and unopened alcoholic beverage cans.
