An officer patrolling northbound on Naperville Road observed a white sedan without a front license plate traveling at 42 mph in a 35 mph zone. After the officer made a U-turn to follow the vehicle, the driver accelerated to speeds of 55 to 60 mph in a 40 mph zone and repeatedly crossed over the lane boundaries. The officer initiated a traffic stop and noted that the driver fumbled for 20 seconds to find their license before admitting to speeding. The officer observed that the driver had bloodshot, glassy eyes, moderately slurred speech, and a strong odor of an alcoholic beverage. When asked about alcohol consumption, the driver admitted to having a couple of beers and a shot after work. The driver was asked to step out of the vehicle to perform Standardized Field Sobriety Tests. During the tests, the driver demonstrated multiple clues of impairment, including failing to keep their balance, missing heel-to-toe contact, swaying, and stopping during the walking stage. After refusing a preliminary breath test, the driver was informed they were under arrest for a DUI. The driver exhibited defensive resistance by spinning around, leaning against the vehicle, and attempting to pull their arm away as officers applied handcuffs. Once secured, the driver was transported to the police station, where they again refused to provide a breath sample for the formal testing instrument. These charges are merely accusations and the defendants are presumed innocent until proven guilty. An arrest is not a finding of guilt: that’s something for a court to decide.
