On 5/31/2023, at approximately 09:55 AM, an officer patrolling the Sears parking lot observed a male in a red hooded sweatshirt and pants sleeping across the walkway on the western side of the Sears building. The officer approached the individual and informed him that sleeping in that area was not permitted, also mentioning the issue of trespassing. Despite requests for identification, the individual did not cooperate verbally or physically. After several attempts, the officer reiterated that a trespassing investigation was being conducted and required valid identification. The individual reacted by aggressively handling a bag tied around his back, prompting the officer to caution him against reaching for items inside. Upon locating his ID in the bag, he handed it over, identifying himself as Julio. Subsequently, he emptied the contents of his bag onto the walkway, then proceeded to kick loose items towards the officer and his bike into the roadway. As the officer informed Julio of his impending handcuffing for the ongoing investigation, he resisted by pulling away and tensing up when the officer tried to restrain him. Despite warnings, He continued to resist, leading to a brief physical altercation where force was used to maintain control. Following a struggle, He attempted to flee towards Wells Fargo Bank but eventually complied and was secured. After contacting the on-duty supervisor for assistance, He was searched, secured, and transported to the County jail. Medical attention was sought for his preexisting injuries before he was cleared for jail and processed without further incident. Julio knowingly trespassed on the property despite warnings and is being charged with trespassing and resisting arrest with violence.
