Officers patrolling the area of Merriman Rd and N. Portage Path observed a gray GMC Envoy traveling beside them on the driver's side while heading north on N. Portage Path. The vehicle attempted to turn left onto Merriman Rd but veered off the road and onto nearby railroad tracks. The driver, later identified as Eric Bucholtz, continued to drive along the tracks until the vehicle became stuck. Despite repeated attempts to accelerate and free the vehicle, Bucholtz could not move it further. An officer exited his patrol car and approached the passenger side of the GMC, issuing verbal commands for Bucholtz to stop the vehicle. However, Bucholtz ignored these commands and continued trying to drive down the tracks. The officer then moved to the driver's side and again issued multiple commands to shut off the vehicle. After a short time, Bucholtz complied and turned off the engine. The officer informed Bucholtz that he was under arrest and repeatedly ordered him to exit the vehicle. Bucholtz refused, insisting that he had simply made a wrong turn. Additional officers arrived on the scene, and Car 23 assisted in escorting Bucholtz from the vehicle, at which point he was placed under arrest. Despite being read his Miranda Rights twice, Bucholtz refused to acknowledge them. During the interaction, the officers noted that Bucholtz was stumbling, had slurred speech, and glossy eyes. Because Bucholtz refused to exit the vehicle voluntarily and had to be physically removed, Standardized Field Sobriety Tests (SFSTs) were not conducted. During a tow inventory of the vehicle, officers found a black dashcam that had recorded the incident, as well as an open container on the rear passenger seat—a glass bottle of Woolford Reserve Whiskey. The contents of the bottle were poured out, and the bottle was collected as evidence. Under Miranda, Bucholtz was asked if he had consumed any alcohol that night, but he refused to comment. He was then transported to the station's 5th floor for a breathalyzer test conducted by Car 58, which he ultimately refused. Bucholtz was taken to Summit County Jail, and his vehicle was towed. ⚠️Note: Footage from this video was obtained via the Ohio Public Records Act (R.C. 149.43) All persons featured on the channel are to be presumed innocent until proven guilty in a court of law.
