DELHI TOWNSHIP, OH - On January 2nd, 2020 at 1:23AM, an officer with the Delhi Township Police Department observed a vehicle unable to maintain lanes. The officer activated his emergency lights in an attempt to pull the vehicle over, but was initially unsuccessful. The officer had to twice activate his sirens in order to get the attention of the driver before he stopped. As the officer approached the vehicle and knocked on the driver side door, the suspect appeared startled and unaware that the officer was standing outside his car. The suspect claimed that the emergency lights were only on for "five seconds" and that the music may have been too loud to hear the sirens. He further claimed that he was coming from a nearby Waffle House to grab food for his father. After identifying the suspect and speaking with a corporal, the officer went back and asked him to step out of the vehicle. As the suspect stepped onto the lawn median, he appeared unsteady on his feet. The suspect told the officer that he had left from a local bar before stopping to get food at his mother's behest. The officer then administered a field sobriety test on the suspect. During the horizontal gaze nystagmus test, the suspect had to be told how to perform the exercise several times as he was unable to follow instructions. On the fourth and final attempt, the officer observed distinct and sustained nystagmus at maximum deviation and the onset of nystagmus prior to forty-five degrees, but continued to tell the suspect to follow the stimulus as he was looking at the officer instead. For the walk-and-turn test, the suspect stepped off line, used his arms for balance, did not count each step out loud, took a tenth step to make the turn, had to be retold to take nine steps, and failed to touch heel-to-toe during multiple steps. At the conclusion of the exercise, the suspect asked to perform the test again which the officer denied. During the one leg stand test, the suspect failed to maintain balance, used his arms for balance, and did not count as instructed. Following the field sobriety test, the suspect was arrested for operating vehicle under the influence of alcohol, or OVI, third offense.
