On October 21, 2023, Las Cruces Police Officers responded to a motor vehicle accident where a vehicle crashed into a bus stop. Witnesses observed a woman slumped over behind the wheel, while the vehicle was still moving down the road. They pulled the woman out of the vehicle and discovered she had 3 children in the vehicle - all under the age of 7. Paramedics determined that the woman had overdosed and administered Narcan. The woman then refused further medical treatment and exited the ambulance. Officer Rivera wrote in his police report that the woman "had her fist balled and was in a modified fighting stance while breathing extremely heavily in what I perceived was her preparing for a fight." She was taken down to the ground and arrested. Video shows she was wearing an electronic monitoring device on her ankle. She was transported to the Las Cruces police station where she was to be interviewed by a Drug Recognition Expert (DRE). The DRE required her to submit to an evidential breath test with results of 0.000. However, the EBT malfunctioned and did not provide a result, so the woman was transported to a local hospital for medical clearance and a blood draw. The first hospital refused to conduct the blood draw, so she was taken to a 2nd hospital. Once the blood draw was completed, she was transported to the Dona Ana County Jail. She was charged with Driving While Intoxicated (2nd Offense) and Resisting Arrest. On January 5, 2024, all charges were dismissed by the prosecutor. As of April 2025, charges have not been refiled.
