It really helps us do original reporting like this. 🔍 Episode Overview: At around 1:30 AM on February 20, 2022, Officer Joshua Baar from the Tampa Police watched a white 2016 Mercedes speed on Armenia Avenue. The car hit 68 MPH in a 40 MPH zone and ran through three red lights. Officer Baar decided to follow and eventually pulled the vehicle over on Howard Avenue. He got out of his car and approached the driver of the Kia. The driver was a young woman named Emily Smith, 22 years old. While talking, Officer Baar noticed signs that Emily might be impaired. He asked her if she had been drinking. She first lied and said she hadn’t. But then he asked about her wristbands from a nightclub called Eden. She admitted she had been there earlier that night. She also finally said she had two drinks before driving. Sensing she might be drunk, Officer Baar moved her to a nearby parking lot to do field sobriety tests. He started with the Horizontal Gaze Nystagmus (HGN) test. Next was the Walk and Turn. During that test, Emily didn’t heel-to-toe properly and didn’t count aloud as told. The last test was the One Leg Stand. She failed to lift her foot correctly. Because she was driving erratically and showed signs of being drunk, Officer Baar told Emily she was under arrest for DUI. As he cuffed her, she suddenly resisted. She punched him in the back of the head several times. Another officer quickly stepped in, and after a short struggle, she was placed in the patrol car. At the Hillsborough County Sheriff’s Office, Emily refused to give breath samples. She was charged with DUI, resisting arrest with violence, and driving on a suspended license. She was later released while waiting for her court date. Emily had been arrested for DUI before, on September 29, 2021.
