This Man Went Grocery Shopping — Cop Arrests Him Without Even Checking His ID. A routine trip to Walmart turns into a shocking confrontation when officers suddenly detain a man while he and his partner are grocery shopping. According to the man, moments after entering the store, a sheriff approached him, immediately placed him in handcuffs, and told him he was under arrest for trespassing. The officer did not first ask for identification or confirm the man’s identity before taking him into custody. Instead, the officer reportedly assumed he was someone else who had previously been trespassed from the property. Under the Fourth Amendment, officers must have probable cause before making an arrest. That includes confirming the identity of the person suspected of committing the offense. When an arrest is made based on mistaken identity or without verification, it raises serious constitutional questions about unlawful detention and the limits of police authority.
